G. NS Re~orts to BRL. In furtherance of this Section I of the Agreement, <br />NS agrees to provide BRL on a monthly basis ~vith an accurate written report on <br />the average daily amber of freight trains that operated over the Nickel Plate line <br />through BRL. leach such report shall be provided to BRL by NS within 30 days <br />of the end of the applicable month, and shall be contemporaneously submitted by <br />NS to the STB. NS shall provide such monthly repons until the later of (i) the <br />date eight years from the Clog~ville Connection completion date or (ii) the date <br />ten years from the date on which the STB's approval of the Conrail Application <br />becomes effective. In furtherance of this Section I, NS also agrees to promptly <br />notify BRL in xwiting of the date on which construction oft.he Vermilion double <br />connection has been fully completed and the date on which construction of the <br />remainder of the Cloggsville Connection project has been fully completed. <br /> <br /> II. Grade Crossing Improvements,_. NS hereby commits to work cooperatively <br />with BRL and other interested communities adjacent ro the Nickel Plate line between <br />Cleveland (Cloggsville) and Vermilion in seeking the support of ami funding from the <br />applicable state and other governmental authorities for upgrading the crossing protection <br />(e.~.. installing gates and flashing lights) at the 19 public at-grade highway mil crossings <br />on the Nickel Plate line between Cloggsville and Vermilion, which includes those grade <br />crossings located in BRL. NS will work with and cooperate with the pertinent state <br />authorities in developing prioritization of and a timetable for installation of these <br />upgrades. NS commits to act with all deliberate speed to expedite the ena. ineering, state <br />review and approval and construction phases of such projects.
