I. Modifications to Operatine Plan. In consideration of thc concerns of BKL and <br />other communities in the Greater Cleveland area about increases in train frequencies <br />projected for certain of the lines that NS will operate following approval by the Surface <br />Transportation Board of the Conrail Application, NS agrees to modify its original <br />Operating Plan. The modifications to the Opera~g Plan are described in NS' Mitigation <br />Proposal for Train Frequencies in Greater Cleveland and Vicinity, which was submitted <br />to the STB on April 1(5, 1998 (hereinafter, the "Mitigation Proposal"), and these <br />modifications are summarized herein. NS agrees to modify its Operating Plan by <br />constructing what is termed the "Cloggsville Connection," as described more particularly <br />in subsection A hereofi by revising the routing of certain trains that would have been <br />routed on the Nickel Plate east of Cloggsville under the original Operating Plan to a <br />different routing on existing Conrail lines, as described more particularly in subsection B <br />hereofi and by revising the projections of train frequencies for lines to be controlled by <br />NS post-Transaction from the numbers contained in the original Operating Plan to a <br />different set of numbers, as described more particularly in subsection C hereof. <br /> <br /> A. Clog~,~wille Connection Construction: NS agrees to construct <br /> <br /> the Clog~ville Connection, which construction is comprised of two main <br /> elements: up.m-ading the mil lines and facilities between the NS Nickel <br /> Plate line at Cloggsville and the Conrail Lakefront line at CP-190 to <br /> double-~ack main line standards through changes and improvements to <br /> tracks, bridges, connections, signals and other appurtenant mil facilities, as <br /> described more fully in the Mitigation Proposal; and building a double <br /> connection at Vermilion between NS' Nickel Plate line and the Conrail <br /> <br /> <br />
