ORDINANCE NO. 54-99 <br /> <br /> Corrigan, FitzGerald, George, <br /> Roth, Seelie, Smith <br />BY: <br /> <br /> AN ORDINANCE to enact a new Chapter of the Lakewood Codified Ordinances, <br />entitled "Farmers' Market" for the purposes of establishing and regulating a special event <br />Farmers' Market within the City of Lakewood. <br /> <br /> WHEREAS, Farmers' Markets have become a popular'venue for residents of urban <br />communities to obtain locally grown produce; and <br /> <br /> WHEREAS, interest by both farmers and residents of the City has been expressed in <br />establishing a Farmers' Market within the City; and <br /> <br /> WHEREAS, the Farmers' Market Pilot Project conducted for an eight (8) week period <br />during the summer of 1999 was successfully received by producers and residents; and <br /> <br /> WHEREAS, Council wishes to establish a Farmers' Market on an annual basis and <br />regulations for the operation of such market. <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br />Section 1. Producers. "Producers," for purposes of this chapter, shall mean persons who <br />raise their own products upon land owned or leased by themselves. <br /> <br />Section 2. Establishment. A special event Farmers' Market shall be established for <br />the sale of seasonal produce and related products. Said Market shall be open only to <br />producers of their own farm produce, plants and products. <br /> <br />Section 3. Location. The location of the Farmers' Market shall be subject to the <br />approval of the Director of Public Safety in accordance with the City Charter and all <br />local, state and federal laws. <br /> <br />SeCtion 4. Duration. The Farmers' Market may be held weekly from July 1 through <br />September 30 of each calendar year. <br /> <br />SeCtion 5. Permits. All vendors wishing to participate in the Farmers' Market shall <br />file an application with Director of Human Services. All applications shall be subject to <br />approval by the Director of Human Services and shall be submitted with the <br />appropriate fee. U pon approval, the vendor will receive a permit indicating the date(s) <br />of sale, approved items to be sold, and the location where the vendor is permitted to <br />sell their products. The vendor shall have the permit available for inspection, upon <br />request of any City of Lakewood Official, at all times the vendor is offering produce or <br />products for sale. <br /> <br />Section 6. Fees. Any vendor wishing to participate in the Farmers' Market shall <br />submit a non-refundable fee in the amount of $10.00 per each day of participation with <br />their application. Any vendor may request that such fee be waived by the DireCtor of <br />Human Services provided the vendor agrees to participate with the Lakewood <br />Department of Human Services in providing educational assistance in the programs at <br />both east and 'west side gardens or another educational program as approved by the <br />DireCtor of Human Services. <br /> <br />Section 7. Regulations established. Rules and regulations governing the operation <br />of and participation in the Farmers' Market Shall be established by the DireCtor of <br />Human Services and shall be provided to vendors participating in the Farmers' Market. <br /> <br />Section 8. Vending restriCtions. <br /> (a) It shall be unlawful for any person to display or offer for sale in the Farmers' <br />Market any product purchased direCtly or indireCtly from any other person or a product not <br />produced upon land either owned or leased by himself. <br /> <br /> <br />
