Please substitute for Ordinance No. 1601 <br />(Placed on 1~ Reading and referred t~ the Rules and <br />Ordinances Committee 2/20/01, Placed on 2"" Reading <br />and referred back bo Rules and Ordinances Committee <br />3/S/0~.) <br /> <br />ORDINANCE NO. 16-01 BY: Corrigan, FitzGerald, George, <br /> Roth, Seelie, Skindell, Smith. <br /> AN ORDINANCE to amend Chapter 729, Gas and Oil Wells of the Codified <br />Ordinances of the City of Lakewood for the purpose of including maintenance, venting <br />and testing of wells in the regulations, to require contractors to file an application with <br />the Building Commissioner for drilling new wells, to require notice to adjacent property <br />owners that work will commence on a well, to limit the location of vent terminals on <br />wells, to require that the City receive notice of operating and abandoned wells and to <br />reorganize Chapter 729. <br /> <br /> WHEREFORE, Chapter 729 of the Codified Ordinances of the City of Lakewood <br />was enacted by Ordinance No. 1091 in 1915; and <br /> <br /> WHEREFORE, since its enactment, there have been numerous changes in <br />technology that the current Chapter 729 does not contemplate; and <br /> <br /> WHEREFORE, improper venting of wells can potentially cause inconvenience to <br />abutting property owners; and <br /> <br /> WHEREFORE, requiring the registration and plugging of abandoned wells will <br />help document well locations throughout the City for notice to the City in the event of <br />an emergency;, and <br /> <br /> WHEREFORE, these amendments are necessary for the public health, welfare <br />and safety. Now, therefore <br /> <br />BE 1T ORDAZNED BY THE CITY OF LAKEWOOD, STATE OF OH[O: <br /> <br /> Section 1. That Chapter 729 of the Codified Ordinances of the City of <br />Lakewood, currently reading as follows: <br /> <br />CHAPTER 729 GAS AND OTL WELLS <br /> <br /> 729.01 PERHI'r REQUIRED; APPL[CAT[ON; DEPOSIT; FEE <br /> Before commenting, or proceeding with the erection or construction of any <br />structure be used for drilling or operating of any gas or oil well in the C;~y, a written <br />application for a permit shall be filed with the Building Commissioner. Such application <br />shall contain the names and addresses of the owner of the land, the owner of the <br />proposed well and the a contractor or driller and shall give a description of the lot or <br />parcel of land and indicate the place where such structure is to be erected and such <br />well located and the distance to the nearest building. The applicant shall deposit with <br />the Commissioner the sum of one hundred dollars ($100) for the payment of any <br />damage to sidewalks, curbing, paving, or otherwise caused by or arising out of the <br />work done in connection with the drilling or operation of such well, and shall pay a fee <br />of ten dollars ($10.00) for such permit. <br /> <br /> 729.02 REGULATIONS FOR DRZLLING AND OPERATION. <br /> No oil or gas well shall be drilled, nor structure erected, at any point in the City <br />within 100 feet of any dwelling house or structure. The drilling and operation of any <br />gas or oil well located within 500 feet of any dwelling house shall cease entirely during <br />the night time between the hours of 8:00 p.m. and 6:00 a.m. Noise adsing from the <br />sharpening of tools, pounding of pipes or use of apparatus at any such well within the <br /> <br /> <br />
