City shall cease during the night time between the hours of 8:00 p.m. and 6:00 a.m., <br />and all such noise is hereby declared to be a public nuisance. The owners, drillers and <br />operators of such wells are hereby required .to prevent water from being thrown from <br />the ropes or appliances used in such operation upon the land or buildings adjoining the <br />land where such well is being drilled and to prevent the water or refuse from such well <br />running upon or being placed upon adjoining property or causing damage in any <br />manner to or upon adjoining property. <br /> <br /> · 729.99 PENALTY <br /> Whoever violates any of the provisions of this chapter shall'be fined not more <br />than two hundred fifty dollars ($250.00), or imprisoned not more than ten days, or <br />both. Each day such violation continues shall be deemed a separate offense. <br /> <br />shall beand is hereby amended to read as follows: <br /> <br />CHAPTER 729 GAS AND OIL WELLS <br /> <br />729.01 DEF[NTI'[ONS. <br /> <br />As used in this Chapter the following terms shall be defined as follows: <br /> <br /> (a) ~Abandoned Well" is any well which is incapable of <br />producing or no longer producing gas or oil. <br /> <br /> (b) ~Drilling" or =Drilling Operations" are the activities involving the cutting or <br />boring of the subsurface strata and subsequently installing and cementing (or <br />mudding) wellbore-casing stdngs. <br /> <br /> (c) ``Open Row Testing" is the activ'~.y involving the flowing (and usually the <br />flaring and/or burning) of natural gas from a well and to the atmosphere for the <br />purpose of simulating gas flow into a pipeline. <br /> <br />``Person" is any person, firm or corporation. <br /> <br /> (e) ~Plugging" or "Well Plugging Operations" are the activities involving the <br />removal of wellbore casing strings and subsequently installing cement plugs and water <br />(or clay gel) spacers to isolate potentially porous strata from the respective well's total <br />depth to the earth's surface. <br /> <br /> (0 =Well Production Operations and Maintenance" is the activity involved in <br />producing oil and gas wells, either dOmestically or commercially, which may include, but <br />is not limited to the reading meters and pressure gauges, purging water from drip <br />separator vessels, or freshwater treating of wells. Well PrOduction Ope~ti0ns and <br />Maintenance soecificaliv include the following' <br /> 1) Swabbing or bailing water from wells: <br /> 2~ Reoaidng leaks from oioelines or wellheads, and u~e of surf~¢-= <br /> eeuioment for cleaninq~ me~ ~udng, and regulatin_a gas or~__~re; or <br /> 3) Collectlna and hauling away weter and gas liauids in excel__ of th~ <br /> amount carded in a 55 gallon container. <br /> <br />(g)``Well Work Over Operations" are the activities involving, but not limited to, <br /> any of the following: <br /> (1) The installation, repair or replacement of wellbore casing and tubing; <br /> (2) The removal of debris or fill material within a well; <br /> (3) The re-stimulation of a hydrocarbon beadng strata using various <br /> treatments, which may include but are not limited to, adds, treated <br /> water, gel, foam, or sand mixtures to enhance gas production from <br /> the well; or <br /> (4) The placement of cement behind casing strings to isolate two or more <br /> distinct porous strata. <br /> <br /> <br />
