729.02 MAINTENANCE, OPERATZONS, AND OPEN 'FLOW TESTING; <br /> REGULATZONS. <br /> <br />(a) Notice Required, Fee: <br /> (1) No person shall conduct. Well Work Over Operations without first <br /> notifying the Building Commissioner in writing on a form provided by <br /> the Building Commissioner. The fee for filing, recording and notifying <br /> the Commissioner is twenty-five dollars ($25.00). <br /> (2) No person shall conduct Open Row Testing without advance <br /> notification to the Lakewood Building Commissioner, in writing on a <br /> form provided by the Commissioner. Upon receipt of said notice, the <br /> Building Commissioner shall forward a copy to the Rre Chief. The fee <br /> for filing, recording and notifying the Division of Rte is ten dollars <br /> ($i0.00). <br /> (3) No person shall conduct Well Production Operations or Maintenance, <br /> as s0ecificallv stated in' ~729.01(f3(!% (2) or (3) above, on existing oil <br /> or gas wells without advance notification to the Lakewood Building <br /> Commissioner, in writing on a form provided by the Commissioner. <br /> Emergency responses are exempt from this notification requirement <br /> until the next business day. There shall be no fee for the filing, <br /> recording and notifying the Commissioner. <br /> <br />(b) Requlati0n~: <br /> (1) No structure shall be erected, nor any oil or gas well fiared at any <br /> point in the City within 100 feet of any dwelling house or structure. <br /> (2) The maintenance of any gas or oil well located within 500 feet of any <br /> dwelling house shall cease entirely dudng the night between the <br /> hours of 9:00 p.m. and 8:00 a.m. except during an emergency <br /> response and barring any unforeseen operational difficulties. <br /> (3) Noise adsing from the operation, testing or maintenance at any such <br /> well within the CT~y shall be in accordance with Chapter 515 of the <br /> Lakewood Codified Ordinances regarding noise control. The owners <br /> and/or operators of such wells are hereby required to prevent a <br /> nuisance from occurring to ali properties due to the operation, <br /> testing, or maintenance of said well. <br /> (4) An open vent terminal from a gas and/or oil well system shall not be <br /> located directly beneath any door, operable window, or other air <br /> intake opening of the building or of an adjacent building, nor shall <br /> any such vent terminal be within 10 feet (3048mm) horizontally of <br /> such an opening unless it is at least 2 feet (610 mm) above the top of <br /> such opening. Vent terminals shall not terminate under the overhang <br /> of a structure. <br /> (5) No person shall erect any permanent structure necessary for the <br /> operations, testing, maintenance, or open flow testing of an oil or gas <br /> well without receiving approval of adequate screening for said <br /> structure from the Architectural Board of Review. <br /> <br />729.03 NEW WELLS. <br />(a) Permit Reeuired. Aoolication. Fe~' <br /> (1) No person shall drill or cause to be drilled a new well for gas or oil <br /> within the City, without first securing a permit to do so. Application <br /> for a permit to drill a well shall be filed with the Building <br /> Commissioner. Such application shall contain the names and <br /> addresses of the owner of land; the owner of the proposed well; the <br /> name and address of the contractor; a cody of the approval from the. <br /> Ohio Department of Natural Resources, Division of Mineral Resou ~rc~ <br /> Management, and any other information deemed necessary by the <br /> <br /> <br />
