The Buildina Commissioner may~ for aood cause shown, qrant an extension to the thirty (30~ day tim~ period above. 729.04 DRILLING NEAR BUILDINGS, RIGHTS OF WAY; FIRE EXTINGUISHERS REQUIRED; DRILLING HOURS. (a) No person shall erect or use any drilling rig within one hundred (100) feet of any buildings in the City, without first obtaining, in writing, the consent of all the owners of such buildings within that radius as measured from the center of the proposed well. Further, no person shall drill a new gas or oil well within fifty (50) feet of any rail road right Of way, street or highway nor within 100 feet of an existing well as measured from the center of the proposed well to the nearest point of the dght of way or dedicated portion of the street or highway or existing well. (b) No person shall be permitted to ddll between the hours of 9:00 p.m. and 8:00 a.m. in any area within the City. Noise arisinq from the ddlling of any well within the Oty shall be in accordance with Chapter 515 (~f the Lakewood Codified Ordinances regarding noise COntrol. (c) Every drilling rig shall be equipped, at a minimum, with two (2) 20lb. dry chemical, multipurpose fire extinguishers. 729.05 DZSCOVERY OF ABANDONED WELL. (a) Any. person being the owner or lessee of land, who discovers an abandoned gas or oil well, shall immediately notify the owner of the land, if discovered by the lessee and the Lakewood Building Commissioner, who shall notify the Rre Chief. (b) Any person who discovers an abandoned gas or oil well during the development 'of any land or the construction of any building shall immediately cease all operations until notification is given to the Building Commissioner, who shall notify the Rre Chief, and such well is treated in accordance with the provisions of this chapter. (c) No person engaged in 'any phase of construction shall remove any casing or piping of any abandoned well until such well has been reported to the Building Commissioner and the Rre Chief and to the representative of the Ohio Department of Natural Resources, Division of Mineral Resources Management. No construction shall take place e'roher over or near an abandoned gas or oil well until such well has been inspected and the type of treatment has been made as ~ by the Fire Chief in conformity with the laws of the State and the provisions of this chapter. 729.06 REGISTRATION REQUIREMENTS All existing, producing gas and oil wells shall be registered between September 1~ and September 30= of each year with the Lakewood Building Commissioner, upon forms as the Commissioner may prescribe, and shall inclUde the names(s) and address(es) of the owner of the land; the owner of the well and the contractor responsible for maintenance. The registration shall include a plot plan drawing of the well location with the distance to the nearest building on the property and the distance to .at least two abutting propertylines. The Building Commissioner shall forward said registration to the Rre Chief. 729.07 PLUGGING OF ABANDONED WELL~ REQUIRED; NOTICE AND INSPECTION RE(~UIRED; FEE. (a) Ail abandoned gas or oil wells shall be plugged in a manner prescribed by the Ohio Department of Natural Resources, Division of Mineral Resources Management, State statutes and this Chapter.
