drilling of the Well has commenced. The cessation of the drilling <br />operation for thirty_ (301 days shall operate to terminate and cancel <br />the permit, and the well shall be deemed abandoned. Thereafter, no <br />person shall ddll or operate any such well within the City without the <br />issuance of another permit. The Buildina Commissioner may~ for <br />aood cause shown, qrant an extension to the thirty (30~ day tim~ <br />period above. <br /> <br /> 729.04 DRILLING NEAR BUILDINGS, RIGHTS OF WAY; FIRE EXTINGUISHERS <br /> REQUIRED; DRILLING HOURS. <br /> (a) No person shall erect or use any drilling rig within one hundred (100) feet of <br />any buildings in the City, without first obtaining, in writing, the consent of all the <br />owners of such buildings within that radius as measured from the center of the <br />proposed well. Further, no person shall drill a new gas or oil well within fifty (50) feet <br />of any rail road right Of way, street or highway nor within 100 feet of an existing well as <br />measured from the center of the proposed well to the nearest point of the dght of way <br />or dedicated portion of the street or highway or existing well. <br /> <br /> (b) No person shall be permitted to ddll between the hours of 9:00 p.m. and <br />8:00 a.m. in any area within the City. Noise arisinq from the ddlling of any well within <br />the Oty shall be in accordance with Chapter 515 (~f the Lakewood Codified Ordinances <br />regarding noise COntrol. <br /> <br /> (c) Every drilling rig shall be equipped, at a minimum, with two (2) 20lb. dry <br />chemical, multipurpose fire extinguishers. <br /> <br /> 729.05 DZSCOVERY OF ABANDONED WELL. <br /> (a) Any. person being the owner or lessee of land, who discovers an abandoned <br />gas or oil well, shall immediately notify the owner of the land, if discovered by the <br />lessee and the Lakewood Building Commissioner, who shall notify the Rre Chief. <br /> <br /> (b) Any person who discovers an abandoned gas or oil well during the <br />development 'of any land or the construction of any building shall immediately cease all <br />operations until notification is given to the Building Commissioner, who shall notify the <br />Rre Chief, and such well is treated in accordance with the provisions of this chapter. <br /> <br /> (c) No person engaged in 'any phase of construction shall remove any casing or <br />piping of any abandoned well until such well has been reported to the Building <br />Commissioner and the Rre Chief and to the representative of the Ohio Department of <br />Natural Resources, Division of Mineral Resources Management. No construction shall <br />take place e'roher over or near an abandoned gas or oil well until such well has been <br />inspected and the type of treatment has been made as ~ by the Fire Chief in <br />conformity with the laws of the State and the provisions of this chapter. <br /> <br /> 729.06 REGISTRATION REQUIREMENTS <br /> All existing, producing gas and oil wells shall be registered between September <br />1~ and September 30= of each year with the Lakewood Building Commissioner, upon <br />forms as the Commissioner may prescribe, and shall inclUde the names(s) and <br />address(es) of the owner of the land; the owner of the well and the contractor <br />responsible for maintenance. The registration shall include a plot plan drawing of the <br />well location with the distance to the nearest building on the property and the distance <br />to .at least two abutting propertylines. The Building Commissioner shall forward said <br />registration to the Rre Chief. <br /> <br /> 729.07 PLUGGING OF ABANDONED WELL~ REQUIRED; NOTICE AND <br /> INSPECTION RE(~UIRED; FEE. <br /> (a) Ail abandoned gas or oil wells shall be plugged in a manner prescribed by <br />the Ohio Department of Natural Resources, Division of Mineral Resources Management, <br />State statutes and this Chapter. <br /> <br /> <br />
