<br /> AN EMERGENCY ORDINANCE, authorizing and directing the Mayor and Director of Public
<br />WOrks, for and on behalf of the City of Lakewood, to accept a conveyance and dedication to Franklin
<br />Boulevard of certain improved land situated at 1511 Warren Road, in the City of Lakewood, Ohio,
<br />
<br /> WHEREAS, this ordinance constitutes an emergency measure in that it provides for the
<br />immediate preservation of the public health, safety and welfare in the City and for the further reason
<br />that the dedication herein authorized is necessary for the construction of the improvements to widen
<br />Franklin Boulevard east of Warren Road, which are urgently needed to protect the safety and health
<br />of the citizens of the City;
<br />
<br /> WHEREAS, Speedway-SuperAmedca LLC, d.b.a. Speedway having offices at 539 South Main
<br />Street, Findlay, Ohio 45840, holds Utle in fee simple to a certain improved parcel of land situated at
<br />1511 Warren Road in the City of Lakewood, Cuyahoga County, State of Ohio;
<br />
<br /> WHEREAS, Speedway desires to split, convey and dedicate Utle of 1,03~, square feet of their
<br />parcel of land to the City;
<br />
<br /> WHEREAS, Ordinance 75-00 adopted 3anuary 2,. 2001, provided the City of Lakewood with
<br />the contracting authority of $150,000 for the purpose of widening Franklin Boulevard east of Warren
<br />Road;
<br />
<br /> WHEREAS. Ordinance. 69-00 adopted February 20, 2001. provided the City of Lakewood with
<br />the appropriation authority of $150.000 for the purpose of widening Franklin Boulevard east of
<br />Warren Road;
<br />
<br /> WHEREAS, Ordinance 4-01 adopted March 5, 2001, provided the City of Lakewood a secured
<br />bond in the amount of $150,000 for the purpose of widening Franklin Boulevard east of Warren
<br />Road;
<br />
<br /> WHEREAS, the Planning Commission at their March 6, 2001 meeting approved a lot split and
<br />approved and referred to City Council dedication of 1,034 square feet to Franklin Boulevard for the
<br />purposes of constructing a dedicated westbound right turn lane onto Warren Road from Franklin
<br />Boulevard;
<br />
<br /> WHEREAS, the City has entered into an agreement with Speedway dated February 16, 2001,
<br />a copy of which is attached hereto as Exhibit "A' and incorporated by reference herein (the
<br />"Agreement"), for the purpose of obtaining said parcel of land by dedicated Plat for good and
<br />valuable consideration, the receipt and legal sufficiently of which was acknowledged within said
<br />Agreement;
<br />
<br /> WHEREAS. this Council determines that it is in the best interest'of the City to accept the
<br />conveyance of said parcel of land as a dedicated plat. in the form attached hereto as Exhibit ,B" and
<br />incorporated by reference herein (the "Plat"); and
<br />
<br /> WHEREAS, this Council by a vote of at least five members elected thereto determines that
<br />this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date
<br />possible as set forth in ART/CLE II], SECTZON 10, 13 of the SECOND AMENDED CHARTER OF THE
<br />Crl'Y OF LAKEWOOD, and that it is necessary for the immediate preservaUon of the public peace,
<br />property, health, safety and welfare and for the usual daily operation of the City and so that
<br />construction of the improvements to widen Franklin Boulevard east of Warren Road may commence.
