BE ]-I' ORDAZNED BY THE CITY OF LAKE'WOOD, STATE OF OH]:O: <br /> <br /> Section 1. That pursuant to the conditions of the aforementioned Agreement, Council <br />hereby formally approves the acquisition of said property hereinabove described, including the terms <br />and conditions set therein, and authorizes the Finance Director to expend funds, to complete the <br />conveyance and dedication described under said Agreement. <br /> <br /> Section 2. That the ~layor and Director of Public Works, on behalf of the City of Lakewood, <br />are hereby authorized and directed to accept the conveyance and dedication of the Plat as part of the <br />Franklin Boulevard public right-of-way, with such additional provisions as are acceptable to and <br />deemed necessary by the Director of Law to protect the public interest. <br /> <br /> Section 3. ]:t is found and determined that all formal action of this Council concerning and <br />relating to the passage of this ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees that resulted in such formal action, <br />were in meetings open to the public, in compliance with all legal requirements. <br /> <br /> Section 4. This ordinance is hereby declared to be an emergency measure necessary for the <br />immediate preservation of the public peace, property, health, safety and welfare in the City for the <br />reasons set forth and defined in the preamble to this ordinance, and provided it receives the <br />affirmative vote of at least five of its members elected to Council, this ordinance shall take effect and <br />be in force' immediately upon its adoption by the Council and approval by the Nayor otherwise, it <br />shall take effect and be in force after the earliest period allowed by law. <br /> <br />President <br /> <br />Approved: <br /> <br />Clerk ~,~ <br />Mayor / <br /> <br />Page 2 of 2 <br /> <br /> <br />
