12650 Detroit Avenue <br /> <br />Lakewood, Ohio 4.4107 · (216) 521-7580 <br /> <br />EXHIBIT A <br /> <br />(216) 228-2514 FAX <br /> <br />AGREEMENT <br /> <br /> .This,A,G.REEMENT .d.a. ted as of this _. dayof f~/'~/'Y 2001 <br />made oy aria oetween the C,ty of Lakewood, Ohio (the "City"), a municipal'corpor~on <br />political subdivision in and of the State, and duly authorized' and validly existing under the laws <br />of the State, and Speedway Super.America LLC, the owner and operator of the gas station <br />located at 1 $11 Warren Road, Lalcewood, Ohio. <br /> <br /> WHEREAS, on August 15, 2000, Speedway SuperAmerica LLC received architectual <br />approval to raze the existing building and construct a new retail sales building, install new <br />pumps, canopy and storage tanks. On October. 4, 2000, Speedway SuperAmerica LLC was <br />'granted a "use variance" by the Planning Commission in order to accomplish the <br /> aforementioned; and, <br /> <br /> WHEREAS, as a result of the proposed construction of a new facility at the <br />aforementioned location, the City desires to create, a right turning lane in the westbound direction <br />of Franldin Boulevard turning North onto Warren Road; and, <br /> <br /> WHEREAS, Speedway SuperAmerica LLC owns the parcel of land abutting the right-of- <br />way intersection which the City desires to widen and improve; and, <br /> <br /> WHEREAS, the Speedway SuperAmerica LLC agrees to convey a designated portion of <br />the parcel (as set forth in Exhibit A a/tached hereto) to the City in order to accomplish such <br />street infrastructure and widening improvements at the aforementioned location; and, <br /> <br /> WHEREAS, the City has prepared and provided a survey of both the parcel of land to be <br />split from the original parcel, as well as the remaining parcel retained by Speedway <br />SuperAmerica LLC, and, further agrees to bear the expense thereof; and, <br /> <br /> NOW, THEREFORE, for good and valuable consideration, the receipt and legal <br />sufficiency of which are hereby acknowledged, Speedway SuperAmerica LLC and the City do <br />hereby agree as follows: <br /> <br />Speedway SuperAmerica LLC will request, approval by the Planning <br />Commission of a lot split of a designated portion of Permanent Parcel <br />Number 314-05-075 (as set forth in Exhibit .4,_ attached hereto); <br /> <br /> <br />
