The City will request approval by the Planning Commission of a <br />certain dedicated plat of Lakewood, Ohio for the purpose of conveying <br />that portion of the parcel to the City for inclusion as part of a <br />permanent, dedicated fight-of-way; <br /> <br />Speedway SupcrAmerica LLC will request a variance with the <br />cooperation of the City for certain building code setback(s) by the <br />Board of Zoning Appeals; <br /> <br />In consideration of five hundred dollars ($500.00) and other valuable <br />consideration received to its full satisfaction from the City, Speedway <br />SuperAmerica LLC will execute a General Warranty Deed conveying <br />said dedicated plat to the City (as set forth in Exhibit A attached <br />hereto); <br /> <br />The City will prepare ail legal documents necessary to perform and <br />complete the provisions of this Agreement, excluding all applicable <br />application fees.
