Section 3. That the existing Chapter 1129 of the Codified Ordinances of the City of <br />Lakewood be amended by enactment of.new section .15 to read as follows: <br /> <br />1129.15 SUPPLEMENTAL REGULATZONS FOR MED~. STORES <br />Conditions applicable to certain businesses carrying adult media. <br /> <br />(a) <br /> <br />Applicability: This section shall apply to any book store, media store, or <br />video store, in which adult media constitutes more than ten percent (10%) <br />but not more than forty percent (~,0%) of the stock in trade, or where adult <br />media occupies more than ten percent (10%) but not more than forty percent <br />(~10%) of the gross public floor area. <br /> <br />(b) <br /> <br />Prohibition of Public Display: The owner or operator of a store to which <br />this section is applicable shall have the affirmative duty to prevent the public <br />display of adult media at or within the portion of the business open to the <br />general public. <br /> <br />(c) <br /> <br />Disolav of Adult Media: Adult media in a store shall be kept in a separate <br />room or section of the store, which room or section shall: <br /> <br />(1) <br /> <br />(2) <br /> <br />Not be open to any person under the age of eighteen (18); <br /> <br />Be Physically and visually separated from the rest of the store by an <br />opaque wall of dura ble material, reaching at least eight (8) feet high or <br />to the ceiling, whichever is less; <br /> <br />(3) <br /> <br />Be located so that the entrance to it is as far as reasonably practicable <br />from media or other inventory in the store likely to be of particular <br />interest to children; and <br /> <br />H) <br /> <br />Have access controlled by electronic or other means to provide <br />assurance that persons under age eighteen (18) will not gain admission <br />and that the general public will not accidentally enter such room or <br />section. <br /> <br /> Section'4. That the existing Section 1161.04 of the Codified Ordinances of the City of <br />Lakewood, now reading respectively as follows: <br /> <br />1161,04 <br /> <br /> (a) <br /> <br />SUPPLEMENTAL REGULATZONS FOR ADULT OR/ENTED <br />BUSZNESSES <br />Puroose. Tn the enactment, execution and enforcement of this title, it is <br />recognized that there are certain uses which, due to the nature of their <br />operation, are recognized as having seriously objectionable operational <br />characteristics, particularly when several of said uses are concentrated in close <br />proximity to each other, thereby having a detrimental effect upon the <br />surrounding area. <br /> <br />The regulation of these uses is necessary to insure that the detrimental effects <br />will not contribute to the blighting, downgrading or other diminution of <br />property values of the surrounding neighborhood. The primary purpose of <br />these regulations is to prevent a concentration of these uses in any one (1) <br />area. Uses subject to these controls are any of the following: <br />(1) adult book store; <br />(2) adult motion picture theater; <br />(3) adult peep show; <br />('~) massage establishment; and/or <br />(5) striptease establishment or showbar. <br /> <br />Page 6 of 17 <br /> <br /> <br />
