together with the costs of the proceedings; the cost of demolishing or removing any buildings <br />or stmcmre_s on the Project Sitei iatere~g Va ~I1 fllIti[~ aial~urae(l i~y tho County (other than <br />funds paid over to the County by the LPE for disbursement by the County) at the Contract <br />Interest Rate from the date of disbursement by the County of each portion thereof pursuant to <br />Section 3.8 hereof to the first day of the June or the December next preceding the <br />commencement of the Contract Period of Years; engineering expenses for the Project Site <br />including, but not limited to, the cost of all necessary soil and other investigations and <br />laboratory testing; the cost of printing and publishing the notices and legislation required; <br />legal expenses; costs of appraisals of the Project Site. Notwithstanding anything contained <br />herein to the contrary, Eligible Project Costs shall not include any commissions, fees and/or <br />expenses which may be owed by the LPE to a broker or finder as a result of or in connection <br />with the County's agreement to pay the Eligible Project COsts to the LPE as provided herein. <br /> <br />"Total Project Costs" shall include, whether incurred before or after the date of this <br />Agreement, the costs of the Project and the Project Activities related thereto (which Total <br />Project Costs, other than the capitalized interest hereinafter provided for in this paragraph, <br />shall in no event exceed the amount specified on the Term Sheet as the "Maximum Total <br />Project Costs") including, but not limited to, the following: the purchase price of the Project <br />Site when acquired by purchase, or the value thereof when appropriated as found by the jury, <br />together with the costs of the proceedings; the cost of demolishing or removing any buildings <br />or structures on the Project Site; interest on all funds disbursed by the County (other than <br />funds paid over to the County by the LPE for disbursement by the County) at the Contract <br />Interest Rate from the date of disbursement by the County of each portion thereof pursuant to <br />Section 3.8 hereof to the first day of the June or the December next preceding the <br />commencement of the Contract Period of Years; engineering expenses for the Project Site <br />including, but not limited to, the cost of all necessary soil and other investigations and <br />labOratory testing; the cost of printing and publishing the notices and legislation required; <br />legal expenses; costs of appraisals of the Project Site. Notwithstanding anything contained <br />herein to the contrary, Total Project Costs shall not include any commissions, fees and/or <br />expenses which may be owed by the LPE to a broker or finder as a result of or in connection <br />with the County's. agreement to pay the Eligible Project Costs to the LPE as provided herein. <br /> <br />DEFINITIONS RELATING TO REPAYMENT OF COSTS <br /> <br />(k) "LPE Loan Repayment Amount" means the .amount equal to the Project Repayment Principal <br /> Amount multiplied by the Repayment Rate. <br /> <br />(1) <br /> <br />"Project Repayment Principal Amount" means one of the following: <br /> <br />1. in the event the LPE does NOT obtain the "No Further Action Letter" following <br /> completion of the remediation of the Project Site pursuant to Section 3.1(0 hereof, the <br /> amount equal to all Eligible Project Costs paid with moneys disbursed out of funds of the <br /> County pursuant to this Agreement <br /> <br />2. in the event the LPE DOES obtain the "No Further Action Letter" following completion <br /> of the remediation of the Project Site pursuant to Section 3.1 (f) hereof, the amoum equil <br /> to the sum of the following: <br /> <br />B-3 <br /> <br /> <br />
