result in a decision for the other party. Working days, as provided in the grievance procedure, shall not <br />include Saturdays, Sundays or holidays. It is understood that there shall be written acknowledgement <br />noting the time'and date the Union and the City have received the grievance in each respective step during <br />the grievance procedure. All withdrawals of grievances by the Union shall be in writing with a copy <br />being sent to 'the Director of Public Works. <br /> <br />10.06 There shall be a grievance committee consisting of the Union President, Vice President, Chief <br />Steward, Secretary and division steward, and any Other person mutually agreed upon. <br /> <br />ARTICLE 11 <br /> <br />PROBATIONARY PERIOD <br /> <br />11.01 New full-time employees shall be considered to be on probation for a period of ninety (90) <br />calendar days and during such probationary period, the City shall have sole discretion to discipline or <br />discharge such employees, and such actions during this period cannot be reviewed through the grievance <br />procedure. <br /> <br />11.02 If an employee is discharged or quits while on probation and is later rehired, the employee shall be <br />considered a new employee and subject to provisions of Section 1 of this Article. <br /> <br />11.03 Any City employee in any department other than Public Works shall be considered a new <br />employee when transferred to Public Works, except those who are currently members of the bargaining <br />unit. Any new employee with the Department of Public Works who has had previous employment with <br />the City of Lakewood shall retain all credits due towards longevity, vacation and sick leave accumulation. <br /> <br />ARTICLE 12 <br /> <br />SENIORITY <br /> <br />12.01 Seniority, for the purpose of layoff', shall be an employee's uninterrupted length of continuous <br />service with the City as a member of the Department of Public Works. An employee shall have no <br />seniority during the probationary period provided in Article 11, but upon completion of the probationary <br />period, seniority shall be retroactive to the date of hire. Management personnel shall not accumulate any <br />seniority while employed outside the bargaining unit. <br /> <br />12.02 The City shall provide the Union with a copy.of the seniority lists and these lists shall be updated <br />every six (6) months. The seniority lists shall contain, in order of seniority, the name, division and date of <br />hire for each employee. Seniority shall be broken when an employee: <br /> <br />A. Quits or resigns. <br /> <br />B. Is discharged for just and proper cause. <br /> <br />C. Is laid offfor a period of more than twelve (12) consecutive months, <br /> <br />Fails to report to work when recalled from layoff within ten (10) working days from the date <br />on which the City sends the employee notice by registered mail (to the employee's last <br />known address as shown on the City's records). <br /> <br />8 <br /> <br /> <br />
