Is absent without leave for three (3) or more working days, unless a reasonable excuse for <br />absence is shown. <br /> <br />12.03 Bargaining unit employees appointed to the position of supervisor on or after March 1, 1985, shall <br />lose all bargaining unit seniority rights on the ninetieth (90~) day fOllowing their appointment. <br /> <br />12~04 Years of service for purposes of promotion shall be defined as years of service with the bargaining <br />unit. For emplOyees hired after January 1, 1995, sick and vacation leave computation shall be defined as <br />years of service only With the City of Lakewood. <br /> <br />ARTICLE 13 <br /> <br />HOURS OF WORK <br /> <br />13.01 The normal workweek for regular full-time employees shall be forty (40) hours of wOrk in five (5) <br />days of eight (8) consecutive hours each day, exclusive of the time allotted for meals, during the period <br />starting at 12:01 a.m. Sunday to midnight Saturday. An employee's workday begins with the <br />commencement of his regular shift. This section shall not be construed as a guarantee of hours of work <br />per day or per week, and the City reserves the right to establish and change hours of work, shifts and <br />schedule of hours, provided that this section shall not be construed to give the City the right to reduce the <br />workweek below forty (40) hours per week for any full-time, permanent, hourly employee. <br /> <br />13.02 In the event a change in hours of work becomes necessary, due to permanent or seasonal <br />requirements, or. a special project agreed to between the City and the Union, the individual(s) concerned <br />and the Union shall be advised then (10) working days prior to the change going into effect. If the Union <br />requests, the parties shall meet and disCUss the reasons for such changes. Further, if there is a dispute as <br />to the change, the parties will attempt to resolve the dispute. It is recognized that the changes will not be <br />made for arbitrary, capricious or discriminatory reasons. <br /> <br />13.03 All employees shall be allowed not less than thirty (30) uninterrupted minutes for a scheduled <br />lunch period, except for other mutually agreed upon schedules. <br /> <br />13.04 There shall be two (2) fifteen (15) minute rest periods on each shift each workday. The rest <br />periods, to the extent practicable, will be scheduled during the middle two (2) hours of each shift, but they <br />may not be scheduled immediately before or after the meal period, or at the start or end of a shift unless <br />requested by the employee and agreed toby the City. Additionally, employees working overtime shall be <br />entitled to a fifteen (15) minute break after two (2) hours of oVertime. Employees of the Division of <br />Refuse and Recycling who are required to work overtime at the end of their regularly scheduled work <br />shift shall be entitled to a fifteen (15) minute paid rest period. Employees may onlybe required to drive a <br />maximum of fourteen (14) consecutive hours. Upon completion of fourteen 04) hours, the employee <br />shall be entitled to a rest period'of eight (8) continuous hours, during which time the employee shall not <br />be required to work. However, following twelve 02) continuous hours of driving, an employee may <br />request to be relieved and, unless working under, emergency conditions, the. employee's request shall be <br />'honored. <br /> <br />13.05 Where two (2) or more employees are qualified to do the job whose hours are being changed, the <br />City shall request volunteers by seniority. If no employee volunteers thc'n, if practical, the least senior <br />employee shall be required to make the change. <br /> <br />9 <br /> <br /> <br />
