a period not to exceed six (6) months, bemuse of personal illness or injury. The employee may (at the <br />employee's oPtion).use any vacation pay prior to going on sick leave without pay. <br /> <br />'19.02 If an employee is off work foran extended period (in excess of six (6) months) due to injury or <br />illness, the City may require that employee to be examined by a physician who specializes in occupational <br />medicine. The physician's decision regarding the ability to perform the essential functions of the job or <br />the reasonable accommodation to perform such functions will be final and binding.' Should it be <br />determined by proper medical authority that the employee will not be able to return to work, perform the <br />essential functions of the job and no reasonable acoommodation exists which would allow the employee <br />to continue working, the City shall have the fight to require the employee to resign and apply for <br />disability retirement. <br /> <br />ARTICLE 21 <br /> <br />UNION LEAVE <br /> <br />20.01 At the request of the Union, a leave of absence with pay may be granted to any employee selected <br />for an Union office, employed by the Union, or required to attend an Union convention, or perform any <br />other function on behalf of the Union necessitating a suspension of active employment for a period not to. <br />exceed two (2) days per contract year. The granting of such a leave will be based upon the operational <br />needs of the employee's department. <br /> <br />20.02 The City agrees to the granting of a leave of absence without pay for one (1) employee selected by <br />the Union to be. employed by the Union under the following conditions: <br /> <br />A. Leaves of absence shall not be longer than one (1) year in duration, <br /> <br />'B. <br /> <br />Ail fringe benefits of the selected individual shall be terminated one (1) month following the <br />start date of the leave of absence and shall be reinstated one (1) month prior to the <br />employee's return. <br /> <br />The selected employee shall not be permitted on City property to conduct any Union activity <br />without written agreement. <br /> <br />Do <br /> <br />The selected employee shall not be entitled to accumulate any seniority during the <br />employee's absence, and the employee's service time with the City shall be adjUSted <br />accordingly with days absent. <br /> <br />E~ <br /> <br />Should a job posting be required to replace the. selected employee on the leave of absence, <br />the job posting shall indicate the position to be filled as temporary in nature. <br /> <br />Upon completion of the leave of absence, the selected employee, shall be returned to the <br />position held prior to his leave of absence with all benefits and wages intact, and the <br />employee's replacement shall return to his previous job. <br /> <br />17 <br /> <br /> <br />
