maintain and improve the efficiency and effectiveness of the City's operations, including the fight to
<br />reorganize, discontinue, enlarge or contract any work; 4) manage the operations and determine the overall
<br />methods, process, means or personnel by which the City's operations are to be conducted; 5) suspend,
<br />discipline or discharge for just cause; 6) layoff, transfer (including the assignment and allocation of work)
<br />within departments or to other departments, assign, schedule, promote or retain employees; 7) determine
<br />'the adequacy of and direct the work force; 8) determine the overall mission of the City as a unit of
<br />government and take actions to carry out that mission; 9) effectively manage and direct the work force
<br />and operations; 10) control the premises and facilities, and determine the number and location of
<br />facilities; 11) promulgate and enforce reasonable employment rules and regulations; 12) introduce new
<br />and/or improved equipment, methbds and/or facilities; 13) determine the size, duties and work methods of
<br />the work force; 14) determine the number of shift,s required and work schedules; 15) establish, modify,
<br />consolidate or abolish jobs (or classifications); 16) determine the manner in which the work is to be
<br />processed or to be subcontracted to outside, independent companies; 17) determine staffing patterns,
<br />including but not limited to, assignment of employees, numbers employed, duties to be performed,
<br />qualifications required and areas worked.
<br />
<br />5.02 The foregoing is subject to the restrictions and regulations governing the exercises of these fights
<br />as are expressly provided herein.
<br />
<br />ARTICLE 6
<br />
<br />NO STRIKE
<br />
<br />6.01 The Union shall not, directly or indirectly, call, sanction, encourage, finance and/or assist in. any
<br />way, nor shall any employee instigate or participate, directly or indirectly, in any strike, slowdown,
<br />walkout, concerted "sick" leave or mass resignation, Work stoppage, picketing or interference of any kind
<br />at any operation or operations of the City for the duration of this Agreement.
<br />
<br />6.02 Violations of Section 1 of this Article shall be proper cause for discharge or other disciplinary
<br />action by the City.
<br />
<br />6.03 The Union shall, at all times, cooperate with the City in continuing operations in a normal manner
<br />and shall actively discourage and endeavor to prevent or temgnate any violation of Section 1 of this
<br />Article. In the event any violation of Section 1 of this Article occurs, the Union shall immediately notify
<br />all employees that the .strike, slowdown, picketing, work stoppage or other interference at any Operation or
<br />operations of the City is prohibited and is not in any way sanctioned or approved by the Union.
<br />Furthermore, the Union shall also immediately advise all employees to return to work at once.
<br />
<br />6.04 The City shall not lockout any employees for the duration of this Agreement.
<br />
<br />ARTICLE 7
<br />
<br />BULLETIN BOARDS
<br />
<br />7.01 The City shall provide the Union with a locked bulletin board in each of the following divisions:
<br />
<br />Refuse and Recycling, Waste Water Treatment Plant, Streets and Forestry, Fleet
<br />Management, Parks and Public Property, Water and Waste Water, and other areas where
<br />time clocks are utilized provided that:
