the termination of his empjby~e~[ for any reason other than discharge for cause, <br />conditioned upon at least one week's notice of such termination by such employee. <br /> <br />(e) All vacations shall be granted and taken at such times as shall be mutually <br />agreeable to the employee and his division head, insofar as possible. Where they are <br />unable to agree, the decision of the division head shall govern. The division head may <br />permit the ~;acation to be taken in other than consecutive days. Each division head shall <br />annually prepare a vacation schedule so devised as to cause minimum interference with <br />normal operation of the division. Yn the event of conflict between employees in regard <br />to vacation time, seniority shall control. · . <br />(f) Notwithstanding the provisions of Ohio R.C. 9.4~, in determining service <br />time, solely for the purpose of the above vacation schedules, for employees employed <br />by the City subsequent to December 31, 1984, prior service time with the State or any <br />political subdivision of the State shall not be credited to the employee to establish an <br />accrued basis of years of service upon entry into City employment. <br /> <br /> 149.09 VACATZONS: PAYMENT XN i'HE EVENT OF DEATH. <br /> In the case of the death of a City employee, the unused vacation leave to the <br />credit of any such emplOyee, compUted as provided in Section 149.08, shall be paid in <br />accordance with Ohio R.C. 2113.04, orto his estate. <br /> <br /> 149.10 HOL/DAYS. <br /> (a) Full-time permanent hourly employees and annual salaried employees, <br />except members of the Divisions of Police and Fire, shall be granted holidays with <br />regular time pay, as follows: <br /> New Year's Day <br /> Day alter Thanksgiving <br /> Memorial Day Chrisb.as Day <br /> Independence Day Good Friday <br /> Labor Day Employee's Birthday <br /> Presidents Day Day Personally Requested <br /> Thanksgiving Day Hartin Luther King Day <br /> <br /> However, no employee shall be compensated for holiday pay unless he works or <br />is available for work on his full regularly scheduled work day next preceding and next <br />following the holiday. <br /> Day alter Thanksgiving Shall not apply to individuals working in the Refuse <br />Deparl~_ent or Wastew. ater Treatment Plant, who. shall receive an extra personal day. <br /> I ne third Monaay in January, or that dam established by Federal law for the <br />observance of the birthday of Dr. Martin Luther King, 3r., is hereby declared to be an <br />annual holiday in the City, in honor of and commemorating the anniversary of the birth <br />of Dr. Martin Luther King, 3r., respecting his many contributions to our way of life and <br />to the American ideals of liberty, justice, equality a. nd opportunity for all. The Mayor is <br />hereby authorized to implement all necessary administrative procedures to put this <br />revised section into effect, including the addition of the same to any existing collective <br />bargaining agreements. <br /> <br /> (b) Whenever any such holiday falls'Saturday, the preceding Fdday shall be' <br />regarded as the holiday and when any such holiday falls on Sunday, the Monday <br />following shall be regarded as the holiday, for all purposes of Sections 149.01 through <br />149.13. <br /> <br /> (c) No,thing herein contained shall be construed to prevent the City as <br />employer from requiring any employee to repurt' for work or to work on any holiday if <br />necessary, by reason of emergency or to carry on essentia municipal functions. <br /> <br />149.11 SICK LEAVE FOR HOURLY Ef4PLOYEES. <br />(a) (1) Effective 3anuary 1, 1979, a full-time, permanent hourly <br /> employee, including Foreman Class A, Who has completed his <br /> probationary period shall be entitled to sick leave on account of <br /> illness or injury incapacitating, him from work, without loss of <br /> regular time pay, vacation, seniority or other rights or privileges, in <br /> an amount not to exceed the following: <br /> <br /> Credited Days as Earned Days per Mo.
