(2) <br /> <br />(3) <br /> <br />Sick leave accrued prior to 3anuary 1, 1979 shall be taken into <br />account in computing the sick leave accumulation and conversion <br />benefit of such er~ployee pursuant to Section lz}9.111.· In <br />calculating sick leaVe hereunder, allowance shall be made for all <br />time spent in the employment of the City, whether' before or after <br />the effective date of this section. <br />Probationary employees shall receive no sick leave during their <br />probationary period but will receive credit upon expiration of their <br />probationary period for all time spent as a probationary employee. <br />Effective in 1977 only, in the event an employee is hospitalized or <br />injured and has proper medical verification, the employee will <br />receive the balance of any paid sick leave up to the maximum to <br />which the employee would have been entitled. <br /> <br /> (b) In the event an employee becomes or continues to be incapacitated from <br />work by reason of illness or injury after his accrued sick leave is used uP, the Mayor <br />may grant further sick leave up to a total of ninety days, in addition to the sick leave <br />accrued as hereinabove provided. <br /> <br /> (c) The Mayor and Division heads are hereby empowered to take such steps <br />as may be reasonably necessary to prevent improper taking of sick leave. Such' steps <br />may include but are not limited to: <br /> (1) Requiring from the employee his affidavit that the absence was or <br /> is neces.~ary for reasons of health; <br /> (2) Requiring that the employee furnish a certificate from a qualified <br /> physician stating that working will be or would have been <br /> definitely injurious to the emnlovee's health n. eh=~ ~+ ....... ,~ <br /> physically Impossible for the e~n~)i~yee to Per~o~'~ ~l~uti'~~ o~'h;; <br /> job; and <br /> (3) Requiring that the employee, at reasonable intervals, submit to <br /> examination by the Commissioner of Health, or by a physician <br /> designated by him. <br /> <br /> (d) In the event that an employee is determined to have taken sick leave <br />without due cause, such leave shall be cancelled forthwith and the employee, ordered to <br />return to work. In addition to any other penalty permitted by law for improper taking of <br />sick leave, an employee may be deprived of wages for the period of his improper <br />absence or compelled to repay any wages he may have received therefor, and may be <br />penalized by forfeiture of any part or .all of his accSrued sick leave. From any disciplinary <br />action which may be taken hereunder the employee shall have the same rights to <br />appeal or to obtain review that pertain in event of disciplinary lay off or discharge. Sick <br />leave accrued but not taken shall not be regarded .as compensable in money. <br /> <br /> 149.111 SXCK LEAVE ACCUI~ULAT]:ON AND CONVERSXON. <br /> (a) All full-time, permanent, hourly employees who are members of a <br />collective bargaining unit may accumulate nin.e, ty days of unused sick leave and they <br />shall be .allowed to. con.vert twenty-five p,e.rca~c (2.5%) of. such .sick leave into a lump <br />sum casn payment up to a maximum or twenty-two ano one-naif days of pay upon <br />retirement, resignation or death. <br /> <br /> (b) Effective 3anuary 1, 1978, all annual, salaried em ployees except members <br />of the Divisions .of Fire and Police, and all full-time, permanent, hourly employees who <br />are not covered by a collective bargaining agreement with the City, may accumulate <br />120 days of unused sick leave and they shall be allowed to convert twenty-five percent <br />of such sick leave into a lump sum cash payment up to a maximum of thirty days of pay <br />upon retirement, resignation or death. <br /> <br /> (c) The lump sum sick leave conversion payment provided for herein shall be <br />made within twenty-one days after retirement, resignation or death. <br /> <br /> (d) All annual salaried employees except the members of the Division of Fire <br />and Police, who have accumulated more than 120 days of sick leave may convert on a <br />three-to-one basis all days accumulated over 120 days into a lump sum cash payment <br />at the end of each calenaar year. <br /> <br /> 149.112 PERFECT AI'rENDANCE BONUS, <br /> Effective April 1, 1983, all annual salaried employees including Foremen Class A <br />employees and the Chiefs of the Divisions of Police and Fire, but excluding all other <br />members of the Divisions of Police and Fire, and full-time permanent hourly employees <br /> <br /> 7 <br /> <br /> <br />
