D. Whoever violates Section 335.01(a) or (c) by operating a <br /> motor vehicle when his or her driver's or commercial driver's <br /> license has been expired for not more than six months is <br /> guilty of a minor misdemeanor. <br /> E. Whoever violates Section 335.05 shall be subject to the <br /> following penalties: <br /> 1. If the offender previously has not been convicted of <br /> or pleaded guilty to a violation of this section or Ohio <br /> R.C. 4507.33, such person is guilty of a misdemeanor <br /> of the first degree. In addition to or independent of <br /> any other sentence that it imposes upon the offender, <br /> and subject to Ohio R.C. 4503.235, the court shall <br /> order the immobilization for thirty days of the vehicle <br /> involved in the offense and the impoundment for <br /> thirty days of the identification license plates of.that <br /> vehicle. The order for immobilization · and <br /> impoundment shall be issued and enforced in <br /> accordance with Ohio R.C. 4503.233. <br /> 2. If the offender previously has been convicted of or <br /> pleaded guilty to one or more violations of this <br /> section or Ohio R.C. 4507.33, such person is guilty of <br /> a misdemeanor of the first degree. In addition to or <br /> independent of any other sentence that it imposes <br /> upon the offender, and subject to Ohio R.C. <br /> 4503.235, the court shall order the criminal forfeiture <br /> to the State of the vehicle involved in the offense. <br /> The order of criminal forfeiture shall be issued and <br /> enforced in accordance with Ohio R.C. 4503.234. <br />(7) Accidents. Whoever violates any provision of Sections 335.12 to <br /> 335.14 is guilty of a misdemeanor of the first degree. <br />(8) Drivers of commercial cars or tractors. (EDITOR'S NOTE: Paragraph <br /> (a)(8) was repealed as part of the 1991 updating and revision of <br /> these Codified Ordinances. See Chapter 341.) <br />(9) Snow emeraencv, Whoever violates Section 351.26 or 351.27 is <br /> guilty o, a minor misdemeanor for a first offense and a <br /> misdemeanor of the fourth degree for each subsequent offense <br /> during the same winter season, <br />(10) Parking meters. <br /> A. Whoever violates any provision of Chapters 353 or 355, <br /> except for illegal parking, is guilty of a misdemeanor of the <br /> fourth degree. <br /> B. Any person who causes, allows, permits or suffers any <br /> vehicle registered in his name, or any vehicle in his <br /> possession or under his control, to be parked or remain <br /> parked in violation of the provisions of Chapters 353 or 355, <br /> is guilty of a minor misdemeanor. <br />(11) Watercraft. <br /> A. Whoever violates Section 381.15 is guilty of a misdemeanor <br /> of the first degree. <br /> B. Whoever violates Section 381.16 is guilty of a misdemeanor <br /> of the fourth degree. <br /> (12) Stopping for school buses. Whoever violates Section <br /> 331.38(a) may be fined an amount not to exceed five hundred <br /> dollars ($500.00), in addition to the license suspension provided in <br /> Ohio R.C. 4507.165. A person who is issued a citation for a <br /> violation of Section 331.38(a) is not permitted to enter a written <br /> plea of guilty and waive his or her right to contest the citation in a <br /> trial, but instead must appear in person in the proPer court to <br /> answer the charge. <br />(12) Stoooina for school buses.. Whoever violates Section 331.38(a) may <br /> be fined an amount not to exceed five hundred dollars ($500,00), <br /> in addition to the license suspension provided in Ohio R.C. <br /> 4507.165. A person who is issued a citation for a violation of <br /> Section 331.38(a) is not permitted to enter a written plea of guilty <br /> and waive his or her dght to contest the citation in a trial, but <br /> instead must appear in person in the proper court to answer the <br /> charge. <br />(13) Placinq danclerous materials on streets.
