D. Whoever violates Section 335.01(a) or (c) by operating a motor vehicle when his or her driver's or commercial driver's license has been expired for not more than six months is guilty of a minor misdemeanor. E. Whoever violates Section 335.05 shall be subject to the following penalties: 1. If the offender previously has not been convicted of or pleaded guilty to a violation of this section or Ohio R.C. 4507.33, such person is guilty of a misdemeanor of the first degree. In addition to or independent of any other sentence that it imposes upon the offender, and subject to Ohio R.C. 4503.235, the court shall order the immobilization for thirty days of the vehicle involved in the offense and the impoundment for thirty days of the identification license plates of.that vehicle.
