(15) <br /> <br />revocation of probationary motorized bicycle licenses for violations <br />of Section 373.27(a) and (b), as provided in Ohio R.C. 4507.163. <br />Ignition interlock devices. Whoever violates or fails to comply with <br />any of the provisions of Section 337.34 is guilty of a misdemeanor <br />of the first degree. <br /> <br />Penalties. Whoever is convicted of or pleads guilty to a violation of the Traffic <br />Code shall be imprisoned for a definite term or fined, or both, which term of <br />imprisonment and fine shall be fixed by the court as provided in this section. <br /> <br />Classification of Maximum Term Maximum <br />Misdemeanor of Imprisonment Fine <br />Rrst Degree 6 Months $1,000.00 <br />Second Degree 90 Days 750.00 <br />Third Degree 60 Days 500.00 <br />Fourth Degree 30 Days 250.00 <br />Minor No Imprisonment 100.00 <br /> <br />shall be and is hereby amended to read as follows: <br /> <br /> 303.99 TRAFFIC CODE MISDEMEANOR CLASSIFICATIONS AND PENALTIES. <br />(a) Misdemeanor Classifications. <br /> (1) General classification. Whoever violates any provision of this Traffic <br /> Code, for which violation no penalty is otherwise provided, is guilty of <br /> a minor misdemeanor on a first offense; on a second offense within <br /> one year after the first offense, such person is guilty of a misdemeanor <br /> of the fourth degree; on each subsequent offense within one year <br /> after the first offense such person is guilty of a misdemeanor of the <br /> third degree. When any person is found guilty of a first offense for a <br /> violation of Section 333.03 upon a finding that the person operated a <br /> motor vehide in excess of the pos'bed speed limit by fifteen miles per <br /> hour or more while passing through a school zone during recess or <br /> while children are going to or leaving school during the opening or <br /> closing hours, or upon a finding that the person operated a motor <br /> vehicle in excess of the posted speed limit by twenty miles per hour or <br /> more, such person shall be fined not less than $150.00 nor more than <br /> $500.00. <br />(2) <br />(3)... <br />(b) Penalties. Whoever is convicted of or pleads guilty to a violaUon of the Traffic <br />Code shall be imprisoned for a definite term or fined, or both, which term of <br />imprisonment and fine shall be fixed by the court as provided in section 2929.21 of the <br />Ohio Revised Code. <br /> <br />(c) Construction Zone Violations. Notwithstanding subsection (b) hereof, upon a finding <br />that any person referred to in subsection (a)(1) hereof or Section 333.99(a) has <br />operated a motor vehicle in violat[on of this Traffic Code, in a construction zone where <br />a sign was then lawfully posted, the court in addition to all other penalties provided by <br />law, shall impose a fine of two times the usual amount imposed for the violation. No <br />court shall impose a fine of two times the usual amount imposed for the violation upon <br />an offender who alleges, in an affidavit filed with the court prior to his sentendng, that <br />the offender is indigent and is unab(e to pay the fine imposed pursuant to this <br />subsection, provided the court determines the offender is an indigent person and is <br />unable to pay the fine. <br /> <br /> Section 2. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this Council, and that all such deliberation of the Council and of any of its <br /> <br /> <br />
