Placed on <br />2"d Reading 2/17/04.) <br /> <br />Ordinance No: 11-04 <br /> <br />FitzGerald, Mmdigan, Seelie. <br /> <br /> AN ORDINANCE amending Section 351.99 of the Lakewood Codified Ordinances <br />for the purpose of increasing parking penalties and waivers cha~ged for related offenses <br />effective May 1, 2004. <br /> <br /> WHEREAS, parking penalties and waivers have not been updated since 1990 and <br />it is necessary to bring these penalUes and waivers in order to help keep pace with the <br />cost of parking enforcement in the City of Lakewood. Now therefore, <br /> <br />BE IT ORDAINED BYTHE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section l. That Section 351.99 of the City of Lakewood Codified Ordinances <br />currently reading as follows: <br /> <br />351.99 PENALTY AND WAIVER. <br /> <br />(a) Whoever violates any of the provisions of this chapter for which no penalty is <br />otherwise provided shall be subject to the penalties provided in Section 303.99. In <br />addition, thereto such parldng in violation of Section 351.18 shall constitute a nuisance <br />and withiri twenty-four hours after oral or written notice to remove such vehicle, <br />delivered by any police officer to the owner or person having possession or control of <br />such vehicle, personally, or by written notice delivered to the residence of such person, <br />or if such person has no place of residence in the City or if such place of residence <br />cannot be found with reasonable diligence, then after such written notice is attached to <br />the vehicle, such owner or person shall cause such vehicle to be removed from the <br />streets. Upon failure of the owner or person to so remove such vehicle, the Division of <br />Police and each officer thereof is hereby authorized to remove or cause any vehicle so <br />parked to be removed from the street and stored. <br /> <br />(b) Whoever violates any of the provisions of Section 355.06(a), Co) or (c), or <br />Chapter 353 may, in lieu of other penalties provided for the.violation of such provisions <br />and upon signing a waiver, be fined six dollars ($6.00), if such violator pays such fine at <br />the Traffic Bureau, in person or by mail, within forty-eight hours, or, if not within forty- <br />eight hours, then in the sum of ten dollars ($10.00) if such violator pays such amount <br />at the Traffic Bureau, in person or by mail, within seventy-two hours from the time of <br />violation. In the event such violator does not pay the fine as hereinbefore provided, <br />then a warrant shall be issued and such violator shall be subject to the penalties <br />otherwise provided for the violation of such provisions. <br /> <br />(c) Whoever violates Section 351.01(a) through (p), (r) 'or (s) through Section <br />35t.18 or Section 351.20CO) or (c) or Section 351.23(a), (b), (c) or (d) may, in lieu <br />of the other penalties provided for the violation of such provisions and upon signing a <br />waiver, be fined ten dollars ($10.00) if such violator pays such fine at the Traffic <br />Bureau, in person or by mail, within forty-eight hours, or if not within forty-eight hours, <br />then in the sum of twenty dollars ($20.00) if such violator pays such amount at the <br />Traffic Bureau, in person or by mail, within seventy-two hours from the Ume of <br />violation. In the event such violator does not pay the fine as hereinbefOre provided, <br />then a warrant shall be issued and such violator shall be subject to the penalties <br />otherwise provided for the violation of such provisions. <br /> <br /> <br />
