<br />fixtures !\Ild installation which were placed in the Demised P~emises by <br />Lessee and which are designated in said notice and repair any damage <br />occasioned by such removal and in default thereof Lessor may effect said <br />removals and repairs at Lessee's expense. <br /> <br />3. In the event ofthe making of such alterations, improvements and additions <br />as herèin provided, Lessee further agrees to indenmify and save harmless <br />the Lessor ftom all costs, expenses, liens, claims, or damages arising out <br />o~ or resulting ftom the undertaking or making of said alterations, <br />additions or improvements. <br /> <br />ARTICLE VIII <br /> <br />MAINTENANCE OF DEMISED PREMISES <br /> <br />I. Lessor sball maintain the roo~ exterior walls, any doors or windows <br />therein; and any structural portions of the Demised Premises; making <br />repairs thereto becomíng necessary during the term unless occasioned by <br />any act or negligence of Lessee, its agents, contractors, invitees, or <br />empÍoyees in which event such damage shall be repaired by Lessòr at <br />Lessee's sole cost and expense. In addition, within two months of the <br />signing of this . lease, Lessor will commence replacement of all the <br />windows on the east fuce of the Demised Premises (the side along <br />Wyandotte Avenue) which have not yet been replaced. The replacement <br />of these windows is to be completed as soon as possible, but no later than <br />November 1,2004. <br /> <br />2. Lessee covenants and agrees to keep and maintain the. Demised Premises <br />in good order, condition and repair, and to promptly make all repairs or <br />replacements becoming necessary during the term inclnding, but without <br />limitation, repairs or replacements of glass (which shall be replaced with <br />glass ofthe same size and quality). <br /> <br />3. Lessee shall continue its maintenance agreement with respect to the <br />heating, air conditioning and ventilating equipment servicing the Demised <br />Premises. In the event all or any portion of said heating, air conditioning <br />or ventilating equipment needs to be replaced during the term of this lease, <br />said obligation will be at the expense of Lessor. <br /> <br />4. On default of Lessee in making repairs or replacements required to be <br />made by Lessee hereunder or in maintaining the Dèmised Premises, <br />Lessor may, but shaH not be required to make such repairs or replacements <br />or to maintain the Demised Premises for the Lessee's account, and the <br />expense thereof shall constitute and be collectible as additional rent, <br />payable by Lessee on demand, or, at Lessor's election, together with the <br />next installment of rent due hereunder. <br /> <br />4 <br />
