<br />AN ORDINANCE authorizing the Mayor or his designee to engage contracting firms to
<br />provide professional services in the design, preparation of specifications and contract
<br />administration and to advertise for bids and enter into contract with the lowest and best bidder for
<br />Site Preparation, in support of the retention and expansion of Phil Vedda & Sons, Inc., (Vedda)
<br />including Excavation and Grading, GEOPIER Foundation Company, Inc. and Geogrid Fabric Soil
<br />Reinforcement, Engineered Fill, Building Slab Reinforcement and all other necessary site work
<br />related to such site preparation of the property located at 12000 Berea Road Lakewood, Ohio
<br />(Permanent Parcel Number 315-25-007) in accordance with the Administrative Code of the City of
<br />Lakewood, contracts not to exceed specified amounts shown without separate resoiution of
<br />Council.
<br />
<br />WHEREAS, the City desires to support the retention, expansion and significant planned
<br />capital investment of Vedda, in the purchase and redevelopment of the property located at 12000
<br />Berea Road, Lakewood, Ohio (PP#315-25-007); and
<br />
<br />WHEREAS, the City retained Hull and Associates, Inc to undertake a Phase I/II
<br />Environmental and Geotechnical Assessment of the vacant site at 12000 Berea Road which
<br />indicated costly geotechnical soil issues on the site, far exceeding the typical site preparation
<br />costs, that affect the ability to construct a building on the site; and
<br />
<br />WHEREAS, the City further consulted with a team of experts to document the necessary site
<br />preparation and to develop associated cost estimates due to the geotechnical soil issues present
<br />on the site; and
<br />
<br />WHEREAS, pursuant to Ordinance 63-04 adopted by Lakewood City Council on
<br />2004, the City of Lakewood is authorized to enter into a Development Agreement with Phil Vedda
<br />& Sons, Inc. setting forth the. respective rights and obligations of both parties regarding the Vedda
<br />Printing expansion project, including the City's obligation to provide Two Hundred Thousand Dollar
<br />($200,000.00) through the Public Investment Program (PIP) arm of the Economic Development
<br />Fund (EDF) Program and Three Hundred Thousand Dollars ($300,000) through issuance of a Tax
<br />Increment Financing (TIF) Bond to fund the necessary site improvements in support of the Phil
<br />Vedda & Sons, Inc. expansion project; and
<br />
<br />WHEREAS, pursuant to Ordinance 65-04 and Ordinance 64-04 adopted by Lakewood City
<br />Council on , 2004, the Mayor is authorized to expend EDF funds and to establish a TIF
<br />for the purpose of funding the necessary Site Preparation; and
<br />
<br />WHEREAS, this Council by a vote of at least five (5) members elected hereto determines
<br />that this ordinance is an emergency measure, and that this ordinance shall take effect at the
<br />earliest date possible as set forth in ARTICLE III, SECfIONS 10 and 13 of the SECOND AMENDED
<br />CHARTER OF THE CITY OF LAKEWOOD, and that immediate action is necessary to provide for the
<br />immediate preservation of the public property, health and safety, and to facilitate the timely site
<br />preparation necessary for the redevelopment of said property for an economically viable and tax
<br />generating use. NOW, THEREFORE,

<br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO:
<br />
<br />Section 1. . That the Council of the City of Lakewood hereby authorizes the Mayor or his
<br />designee to enter into an agreement with GEOPIER Foundation Company, Inc. as the sole provider
<br />for the Geogrid Fabric Soil Reinforcement, Engineered Fill, and Building Slab Reinforcement, or, in
<br />the alternative to advertise for bids and enter into contract with the iowest and best bidder for
<br />such appropriate alternative method for soil reinforcement, engineered fill, and building slab
<br />reinforcement as the City Engineer shall determine, and to enter into contracts with Hull &
<br />Associates, Inc. and Weber Architecture, Inc. to provide professional services including, but not
<br />limited to, the design, preparation of specifications and contract administration and to advertise for
<br />bids and enter into contract with the lowest and best bidder in accordance with the Administrative
