<br />1. b\ <br /> <br />r-éJ <br />l' if <br /> <br />PLACED ON 1ST READING & REFERRED TO THE <br />RULES & ORDINANCES COMMITTEE 4/18/05. <br />PLACED ON 2ND READING 5/2/05. <br /> <br />Ordinance No. <br /> <br />26-05 <br /> <br />By: Corrigan, Demro, Dever, Dunn, <br />FitzGerald, Madigan, Seelíe. <br />An Ordinance to repeal Chapter 729, Gas and Oil Wells, ofthe Codified <br />Ordinances of the City of Lakewood. <br /> <br />Î <br />¡ <br /> <br />Whereas, the City wishes to attract large-scale development; and <br /> <br />Whereas, in order to compete for and to attract large-scale develþþment, the city <br />must have a competitive fee structure; and <br /> <br />Whereas, competitive fee structures will keep the cost of doing business in <br />Lakewood equitabie, <br /> <br />Whereas, after a comprehensive review of our permit fee structure and an <br />analysis of our neighboring communities fee structures, the Administration is <br />recommending the elimination, lowering and increase of various fees; and <br /> <br />Whereas, these adjustments will result in the stimulation and furthering of <br />e¢onomic activity, especially in the area of new construction. Now therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That, Chapter 729, Gas and Oil Wells, of the Codified Ordinances of <br />the City currently reading as follows: <br /> <br />729.01 DEFINmONS. <br />As used in this chapter the following terms shall be defined as follows: <br />(a) "Abandoned Well" is any well which is incapable of producing or no longer <br />producing gas or oil. <br /> <br />(b) "Drilling" or "Drilling Operations" are the activities involving the cutting or boring of <br />the subsurface strata and subsequently installing and cementing (or mudding) well bore· <br />c('Ising strings. <br />j <br /> <br />(6) "Open Flow Testing" is the activity involving the flowing (and usually the flaring <br />aM/or burning) of natural gas from a well and to the atmosphere for the purpose of <br />simulating gas flow into a pipeline. <br /> <br />(d) "Person" is any person, firm or corporation. <br /> <br />(e) "Plugging" or "Well Plugging Operations" are the activities involving the removal of <br />wellbore casing strings and subsequently installing cement plugs and w¡¡ter (or clay gel) <br />spacers to isolate potentially porous strata from the respective well's total depth to the <br />earth's surface. <br /> <br />, ¡ <br />(0 "Well Production Operations and Maintenance" is the activity involved in producing <br />oil and gas wells, either domestically or commercially, which may include, but is not <br />limited to the reading meters and pressure gauges, purging water from drip separator <br />vessels, or freshwater treating of wells.
