<br />(1) Swabbing or bailing water from wells: <br />(2) Repairing leaks from pipelines or wellheads, and use of surface equipment for <br />cleaning, measuring, and regulating gas pressure; or <br />^ (3) Collecting and hauling away water and gas liquids In excess of thàt amount <br />carhed in a fifty-five (55) gallon container. <br /> <br />(g) "Well Work Over Operations" are the activities involving, but not limited, to, any of <br />the following: <br />(1) The installation, repair or replacement of wellbore casing and tubing; <br />(2) The removal of debris or fill material within a well; <br />, (3) The re-stimulation of a hydrocarbon bearing strata using various treatments, <br />wO)ch may include but are not limited to, acids, treated water, gel, foam, or sand <br />mi*tures to enhance gas production from the well; or ' <br />^ (4) The placement of cement behind casing strings to isolate two or mo~e distinct <br />porous strata. <br /> <br />729.02 MAINTENANCE, OPERATIONS, AND OPEN FLOW TESTING; <br />REGULATIONS. <br />(a) Notice Required; Fee. ¡ <br />(1) No person shall conduct Well Work Over Operations without first potifying the <br />Building Commissioner in writing on a form provided by the Building Corrlmissloner. The <br />fee for filing, recording and notifying the Commissioner is twenty-five'dollars ($25.00), <br />(2) No person shall conduct Open Flow Testing without advance notification to the <br />L~kewood Building Commissioner, in writing on a form provided by the c'Oi1)missioner. <br />Uppn receipt of said notice, the Building Commissioner shall forward a copy to the Fire <br />C,,¡ef. The fee for filing, recording and notifying the Division of Fire Is ten dpllars <br />~~ ' <br />(3) No person shall conduct Well Production Operations or Maintenance, as <br />specifically stated in Section 729.01(f)(1), (2) or (3) above, on existing oil or gas wells <br />without advance notification to the Lakewood Building Commissioner, in writing on a <br />form provided by the Commissioner. Emergency responses are exempt from this <br />notification requirement until the next business day. There shall be no fee for the filing, <br />recording and notifying the Commissioner. <br /> <br />(b) Regulations. , <br />i (1) No structure shall be erected, nor any oil or gas well flared at any point in the <br />City within 100 feet of any dwelling house or structure. <br />, (2) The maintenance of any gas or oil well located within 500 feet of any dwelling <br />house shall cease entirely during the night between the hours of 9:00 p,m. and 8:00 <br />a.m. except during an emergency response and barring any unforeseen operational <br />difficulties, <br />(3) Noise arising from the operation, testing or maintenance at any such well within <br />thè City shall be in accordance with Chapter 515 of the Lakewood Codifièd Ordinances <br />règarding noise control. The owners and/or operators of such wells are hereby required <br />tôTprevent a nuisance from occurring to all properties due to the operation, testing, or <br />maintenance of said well. <br />(4) An open vent terminal from a gas and/or oil well system shall not be located <br />directly beneath any door, operable window, or other air intake opening of the building <br />of' of an adjacent building, nor shall any such vent terminal be within 10 feet (3048 <br />mill) horizontally of such an opening unless it is at least 2 feet (610 mm) above the top <br />of such opening. Vent terminals shall not terminate under the overhang 'of a structure, <br />(5) No person shall erect any permanent structure necessary for the ,operations, <br />testing, maintenance, or open flow testing of an oil or gas well without receiving <br />approval of adequate screening for said structure from the Architectural BOard of <br />Review. <br /> <br />7:?9.03 NEW WELLS. <br />(a) Permit Required; Application; Fee. <br />, (1) No person shall drill or cause to be drilled a new well for gas or oil within the <br />
