<br />729.04 DRILLING NEAR BUILDINGS, RIGHTS OF WAY; FIRE EXTINGUISHERS <br />REQUIRED; DRILLING HOURS. <br />(a) No person shall erect or use any drilling rig within one hundred (100) feet ,of any <br />buildings in the City, without first obtaining, in writing, the consent of all the owners of <br />such buildings within that radius as measured from the center of the proposed well. <br />Further, no person shall drill a new gas or oil well within fifty (50) feet of any railroad <br />rig\1t of way, street or highway nor within 100 feet of an existing well as \neasured from <br />th~ center of the proposed well to the nearest point of the right of way or dedicated <br />portion of thè street or highway or existing well. <br /> <br />(b) No person shall be permitted to drill bètween the hours of 9:00 p.m. and 8:00 a.m. <br />in any area within the City. Noise arising from the drilling of any well within the City <br />shall be in accordance with Chapter 515 of the Lakewood Codified Ordinances regarding <br />noise contrOl. <br /> <br />,_, . J <br />(C)' Every drilling rig shall be equipped, at a minimum, with two (2) twenty pound (20 <br />lb.) dry chemical, multipurpose fire extinguishers. <br /> <br />779.05 DISCOVERY OF ABANDONED WELL. <br />(a) Any person being the owner or lessee of land, who discovers an abaAdoned gas or <br />oil well, shall immediately notify the owner of the land, if discovered by the lessee and <br />the Lakewood Building Commissioner, who shall notify the Fire Chief. <br /> <br />(b) Any person who discovers an abandoned gas or oil well during the development of <br />any land or the construction of any building shall immediately cease all operations until <br />n$~ification is given to the Building Commissioner, who shall notify the Fire Chief, and <br />su~h well is treated in accordance with the provisions of this chapter. <br /> <br />(c) No person engaged in any phase of construction shall remove any casing or piping <br />of any abandoned well until such well has been reported to the Building Commissioner <br />and the Fire Chief and to the representative of the Ohio Department of Natural <br />Rèsources, Division of Mineral Resources Management. No construction shall take place <br />either over or near an abandoned gas or oil well until such well has been inspected and <br />the type of treatment has been made as approved by the Fire Chief in conformity with <br />the laws of the State and the provisions of this chapter. <br /> <br />729.06 REGISTRATION REQUIREMENTS. , <br />í All existing, producing gas and oil wells shall be registered bètween September <br />1st and September 30th of each year with the Lakewood Building Commissioner, upon <br />forms as the Commissioner may prescribe, and shall include the names(s) and <br />address( es) of the owner of the land; the owner of the well and the contractor <br />responsible for maintenance. The registration shall include a plot plan drawing of the <br />well location with the distance to the nearest building on the property and the distance <br />to ,at least two abutting property Jines. The Building Commissioner shall forWard said <br />registration to the Fire Chief. <br />'t <br />729.07 PLUGGING OF ABANDONED WELLS REQUIRED; NOTICE AND <br />INSPECTION REQUIRED; FEE. <br />(a) All abandoned gas or oil wells shall be plugged in a manner prescribed by the Ohio <br />Department of Natural Resources, Division of Mineral ResourCès Management, State <br />stiltutes and this chapter. <br /> <br />(b) The Building Commissioner shall not issue any certificate of occupan(:y for a new <br />building, structure or addition prior to the plugging of an abandoned gas Or oil well <br />located on the same lot. Furthermore, no person shall occupy a new building, structure <br />or addition before an abandoned gas or oil well located on the same lot is plugged. <br />
