<br />(C) No person shall abandon or cause to be abandoned and/or plugged a gas or oil well <br />w,ithout first notifying the Building Commissioner, in writing on a form provided by the <br />Commissioner. The written notice shall include a plot plan indicating thereon the exact <br />location of the well to be abandoned and plugged and includè the measurement of the <br />distance of the well from any structure on, the same and abutting lots and the <br />measurement of the distance of the well from at least two abutting property lines. The <br />f~e for filing, recording and notifying the City is fIVe dollars ($S,OO). <br /> <br />(~) Upon receipt of said notification, the Building Commissioner shall forward said <br />notification to the Fire Chief of the Lakewood Division of Fire who shall caúse an <br />inspection of said well to be conducted prior to the plugging of the well. <br /> <br />729.08 MAINTENANCE OF WELLS; LEAKAGE. <br />No person being the owner of land or lessee of gas or oil well rights upon the <br />land of another, shall permit a gas or oil well to become deteriorated, damaged or in <br />. . <br />Sûch disrepair as to cause leakage of gas or oil, Such leakage of gas or oil shall <br />c$nstitute a nuisance, and repair shall be made forthwith. <br /> <br />7;29.09 PRESCRIBING METHODS WHERE PROVISIONS INEFFECTIVE. <br />If the provisions of this chapter cannot be applied, or if applied, wouid be <br />i~effective in carrying out the protection which this chapter is meant to give, then the <br />Building Commissioner, the Fire Chief or the Ohio Department of Natural Resources, <br />Division of Mineral Resources Management may designate the method to be used. <br /> <br />! <br /> <br />729.99 PENALTY. <br />Whoever violates any of the provisions of mis chapter is guilty of a misdemeanor of the <br />first degree. <br /> <br />is hereby repealed <br /> <br />Section 2.
