Please Substitute for Ordinance No. 100-06. <br />PLACED ON 1ST READING & REFERRED TO ~{E RULES & <br />ORDINANCES COMMITTEE 12/18/06, 2ND READING 1/2/07. <br /> <br />Ordinance No. 100-06 <br /> <br />FitzGerald, Madigan, q~,~=. <br /> <br /> AN ORDINANCE to take effect immediately provided it receives th~ affirmative <br />vote of at least five (5) members elected to Council otherwise, it shall take effect and <br />be in force after the earliest period allowed by law, to enact a new Chapter within the <br />Sanitary Code, Of the Codified Ordinances of the City of Lakewood, titled Public <br />Swimming Pools. <br /> <br /> wHEREAs, the City of Lakewood Pool Ordinances have not been updated in over <br />ten years; and <br /> <br /> WHEREAS, the Ohio Administrative Code contains regulations applicable to public <br />pools; and <br /> <br /> WHEREAS, in conjunction with this legislation, the Administration is proposing <br />adopting two other pieces of legislation that will repeal Chapter 1721, Swimming Pools <br />and create a new chapter, Family Swimm ng Pools, within the Codified Ordinances of <br />the Cty Of Lakev~ood that will regulate Swimming pools more efficiently. <br /> <br /> WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect at the earliest date possible as set forth in ARTICLE III, SECTONS l0 and <br />13 of the SECOND AMENDED CHARTER OF THE City OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of municipal departments in that this legislation <br />should be effective prior to the new pool/pool construction season begins. Now, <br />therefore <br /> <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That a new Chapter, within the Sanitary Code of the Codified <br />Ordinances of the City of Lakewood, titled Public Swimming Pools, is hereby created to <br />read as follows: <br /> <br /> XXXX. o I DEFINITIONS. <br /> The following definitions, terms, phrases, words and their derivations shall apply <br />to this chapter: <br /> (a) "Health Commissioner" means the Health Commissioner of the City of <br /> Lakewood, or his/her authorized representatives. <br /> (b) "Building Commissioner" means the Building Commissioner of the City of <br /> Lakewood or his/her authorized representative. <br /> <br /> XX. XX,02 CONSTRUCTION PERMIT FOR PUBLIC POOLS. <br /> Before work is commenced on the construction of a public swimming pool or <br />public wading pool or on any alteration, addition, remode ng or other improvement <br />thereto, an application for a permit to construct and the plans and specifications and <br />pertinent explanatory data hereinafter required shall be submitted to the Ohio <br />Department of Health and the Building Commissioner for approval. No part of the work <br />Shall be commenced until the Ohio Department of Health, the Health Commissioner and <br />the Building Commissioner have evidenced their approval by a su tab e endorsement <br />upon such plans and specifications, and have granted a permit thereof. <br /> <br /> XXXX.03 CONSTRUCTION PERMIT FEE. <br /> (a) Permits. The fee for the permit to construct a public swimming pool shall <br />be the same as that prescribed for a "Structure" within the Division of Building's Permit <br />Fee Schedule. Such fee is in addition to permit fees applicable to other structures <br />which may be incidental to the pool, or plumbing, sewering or wiring connections <br />therewith. <br /> <br />XXXX.04 COMPLIANCE WITH REQUIREMENTS OF STATE <br /> DEPARTMENT OF HEALTH, <br /> <br /> <br />
