In the construction, operation and maintenance of any swimming pool, laWs of <br />the State of Ohio and the rules, regulations and requirements of the State Department <br />of Health shall be observed. In the event of any conflict between the prov Sons of this <br />chapter and any provision of State law or requirement, rule or regulation of the Ohio <br />Department of Public Health the provision imposing the higher standard or the more <br />stringent requ rement shall be controlling. <br /> <br /> XXXX.O5 LIGHT ARRANGEMENT. <br /> Lights used to illuminate any pool shall be so arranged and shaded as to reflect <br />light away from adjoining premises and public streets. Such lights shall be turned off at <br />10:00 p.r~. and shall remain off until 8:30 a.m. <br /> <br /> XXXX,06 DESIGN AND CONSTRUCTION REQUIREMENTS, <br /> The Building Commissioner shall not issue a permit to construct or approve the <br />construction of any public swimming pool or any alteration, addition, remodeling or <br />other improvement thereto unless all state requirements are met In addton, al <br />indoor public pools which are to be used when the outside temperature is below sixty <br />degrees Fahrenheit shall be provided with facilities for uniform and adequate heat ng of <br />the p0ol room, dressing rooms and water in the pool. <br /> <br /> XXXX.07 ENFORCEMENT. <br /> No person, firm or corporation owning or having the possession, charge or <br />management of any public swimming pool public wading pool, or other artificial body <br />of water shall permit the same to be constructed, used or maintained unless all the <br />provisions of this chapter and all other laws and ordinances relative to any public <br />swimming pools, public wading pools, or other artificial bodies of water are complied <br />with. <br /> <br /> Section 2. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal action were in meetings <br />open to the public in compliance with all legal requirements. <br /> <br /> Section3. That this ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, property, <br />health, safety and welfare in the City and for the usual daily operation of the City for <br />the reasons set forth and defined in the preamble to this ordinance, and provided it <br />receives the affirmative vote of at least five (5) of its members elected to Council, this <br />ordinance shall take effect and be in force immediately upon its adoption by the Council <br />and approval by the Mayor otherwise, it shall take effect and be in force after the <br />earliest period allowed by law. <br /> <br />Adopted:~¢~. ¢~:¢ ~,~ <br /> <br />Approved: <br /> <br />CLERK <br /> <br />MAYOR <br /> <br /> <br />
