<br />PLEASE SUBSTITUTE FOR ORDINANCE NO. 54-06 <br />placed on 1ST READING & REFERRED TO THE <br />COMMMITTEE OF THE WHOLE 6/5/06, 2ND READING <br />6/19/06. <br /> <br />ORDINANCE NO <br /> <br />54-06 <br /> <br />BY' Antonio~ Butler~ Dever, Madigan, Seelie <br /> <br />AN ORDJNANCE to take effect inunediately provided it receives the affiIDlative vote of <br />at least five (5) members elected to Council otherwise, it shan take effect and be in force after the <br />earliest period allowed by law, to amend section 902.04, Rates and Charges, of the Codified <br />Ordinances of the City of Lakewood for the purpose of adjusting sewer rates charged against <br />each lot, parcel of land or premises which may have an active sewer connection With the <br />Municipal wastewater disposal system or which may otherwise discharge wastewater either <br />directly or indirectly into such system or allY part thereof <br /> <br />WHEREAS, the current sewer rate is insufficient to allow the Wastewater Treatment <br />Fund and Wastewater Collections System Fund to contînue to be self-supporting; and <br /> <br />WHEREAS, in order to offset the continuing general increases in capital costs of the <br />wastewater collections and treatment facilities it is necessary for the City to increase the rates <br />charged to the users of the wastewater disposal system as well as provide for the anticipated <br />annualcapital needs for the wastewater collection and treatment system; and <br /> <br />WHEREAS, Chapter 902 of the Codified Ordinances authorizes the City to set sewer <br />rates to distribute the costs of operation and maintenance of the wastewater disposal system and <br />the costs to maintain compliance with applicable standards and regulations of the U S, E ,P ,A <br />proportionately upon all users of said system; <br /> <br />Now therefore, <br /> <br />BE IT ORDAINED BY THE CTIY OF LAKEWOOD, STATE OF OHIO <br /> <br />Section 1 That Section 90204, Rates and Charges, of the Codified Ordinances of the <br />City of Lakewood currently reads as follows: <br />902.04 RATES AND CHARGES <br />(a) The Director ofPublic Works is hereby authorized to annnally establish Sewer rates <br />charged by the Lakewood Division of Water and Wastewater Collections and the <br />Lakewood Division of Wastewater Treatment. <br />(1) Such cbarges and rates shall be made against each lot, parcel ofland or premises <br />which may have an active sewer connection with the Municipal wastewater <br />disposal system or which may otherwise discharge wastewater either directly or <br />indirectly into such system or any part thereof <br />(2) Such charges and rates shall be based on all water used during each one month <br />billing period. <br />(3) Such rates shall be charged monthly <br /> <br />(b) Any lot, parcel of land or premises discharging into the sanitary sewer but not nsing <br />City water wÞ.olly or partly shall, at his own expense be required to install meters or <br />other measuring devices approved by the City Engineer to measure either the water or <br />the discharge to the sanitary sewer <br /> <br />(c) Any lot, parcel of land or premises desiring credit for water consumed for purposes <br />where the water is not returned to the sanitary sewer, shan at his own expense, <br />separately meter the water for such uses. <br /> <br />(d) Effective May 1, 2004, sewer rates charged by the Lakewood Division of Water and <br />Wastewater Collections shall be billed at arate of not more than three dollars ($1 97) <br />per one hundred cubic feet of metered water consumption <br /> <br />l <br />
