<br />Shall be and is hereby amended to read as follows' <br /> <br />902.04 RATES AND CHARGES <br />(a) The Director of Public Works is hereby anthorized to annnally establish sewer rates <br />charged by the Lakewood Division of Water and Wastewater Collections and the <br />Lakewood Division of Wastewater Treatment. <br />(1) Such charges and rates shall be made against each lot, parcel of land or premises <br />which may have an active sewer connection with the Municipal wastewater <br />disposal system or which may otherwise discharge wastewater either directly or <br />indirectly into such system or any part thereof. <br />(2) Snch charges and rates shan be based on all water used dnring each one month <br />billing period <br />(3) Such rates sban be charged monthly. <br /> <br />(b) Any lot, parcel of land or premises discharging into the sanitary sewer but not using <br />City water wholly or partly shan, at his or her own expense be required to install <br />meters or other measuring devices approved by the City Engineer to measure either <br />the water or the discharge to the sanitary sewer. <br /> <br />(c) Any lot, parcel of land or premises desiring credit for water consumed for pnrposes <br />where the water is not returned to the sanitary sewer, shall at his or her own expense, <br />separately meter the water for such uses, <br /> <br />(d) Effective January l, 2007, sewerrates charged by the Lakewood Division of Water <br />and Wastewater Collections shall be billed at a rate of not more than two and forty- <br />seven hundredths dollars ($2 47) per one hundred cubic feet of metered water <br />consumption. <br /> <br />(e) Effective January 1, 2008 sewer rates charged by the Lakewood Division of Water <br />and Wastewater Collections shall be bi11ed at a rate of not more than two and ninety- <br />seven hundredths dollars ($2.97) per one hundred cnbic feet of metered water <br />consumption. <br /> <br />902.05 HOMESTEAD EXEMPTION <br /> <br />There is hereby established a Special Homestead exemption whereby sewer rates charged <br />to homesteads owned by person 65 years of age or older or owned by a permanently or <br />totally disabled person, provided that such person's income falls below the income <br />criteria as established by Obio RC 323.152 and amendments thereto, shall be seventy- <br />five percent (75%) of the sewer rate established pursuant to this chapter <br /> <br />902 06 SUMMER SPRINKLING PROGRAM <br /> <br />The City of Lakewood Division of Water is authorized to provide a Summer Sprinkling <br />Program for residents commencing June 1 and ending August 31 of each year for owner- <br />occupied homes of one-, two-, three-, and four-family residential accounts in good <br />standing. Upon the customer's request, by written application on a form prescribed by <br />the director of Public Works, summer sewer bills issued during the months of June, July, <br />and August (June 1 to August 31) of each year would be based on an average of sewer <br />bi11s issued for the previous nine months (September through May) All applications <br />must be completed at or before April 30 of each year The Division of Water wi11 <br />calculate the summer sprinkling discount The Summer Sprinkling Program wi11 not <br />affect or replace the City's current sewer-exempt meter program. <br /> <br />Section 2. It is found and determined that all fonnal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open meeting <br />of this Council, and that all such deliberations ofthis Council and of any of its <br />committees that resulted in such fonnal action were in meetings open to the public in <br />compliance with al1legal requirements <br />
