54-06 Adjusting Sewer Rates (amended 12/21/09- 85-09)

Shall be and is hereby amended to read as follows' 902.04 RATES AND CHARGES (a) The Director of Public Works is hereby anthorized to annnally establish sewer rates charged by the Lakewood Division of Water and Wastewater Collections and the Lakewood Division of Wastewater Treatment. (1) Such charges and rates shall be made against each lot, parcel of land or premises which may have an active sewer connection with the Municipal wastewater disposal system or which may otherwise discharge wastewater either directly or indirectly into such system or any part thereof. (2) Snch charges and rates shan be based on all water used dnring each one month billing period (3) Such rates sban be charged monthly. (b) Any lot, parcel of land or premises discharging into the sanitary sewer but not using City water wholly or partly shan, at his or her own expense be required to install meters or other measuring devices approved by the City Engineer to measure either the water or the discharge to the sanitary sewer. (c) Any lot, parcel of land or premises desiring credit for water consumed for pnrposes where the water is not returned to the sanitary sewer, shall at his or her own expense, separately meter the water for such uses, (d) Effective January l, 2007, sewerrates charged by the Lakewood Division of Water and Wastewater Collections shall be billed at a rate of not more than two and forty- seven hundredths dollars ($2 47) per one hundred cubic feet of metered water consumption. (e) Effective January 1, 2008 sewer rates charged by the Lakewood Division of Water and Wastewater Collections shall be bi11ed at a rate of not more than two and ninety- seven hundredths dollars ($2.97) per one hundred cnbic feet of metered water consumption. 902.05 HOMESTEAD EXEMPTION There is hereby established a Special Homestead exemption whereby sewer rates charged to homesteads owned by person 65 years of age or older or owned by a permanently or totally disabled person, provided that such person's income falls below the income criteria as established by Obio RC 323.152 and amendments thereto, shall be seventy- five percent (75%) of the sewer rate established pursuant to this chapter 902 06 SUMMER SPRINKLING PROGRAM The City of Lakewood Division of Water is authorized to provide a Summer Sprinkling Program for residents commencing June 1 and ending August 31 of each year for owner- occupied homes of one-, two-, three-, and four-family residential accounts in good standing. Upon the customer's request, by written application on a form prescribed by the director of Public Works, summer sewer bills issued during the months of June, July, and August (June 1 to August 31) of each year would be based on an average of sewer bi11s issued for the previous nine months (September through May) All applications must be completed at or before April 30 of each year The Division of Water wi11 calculate the summer sprinkling discount The Summer Sprinkling Program wi11 not affect or replace the City's current sewer-exempt meter program. Section 2. It is found and determined that all fonnal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations ofthis Council and of any of its committees that resulted in such fonnal action were in meetings open to the public in compliance with al1legal requirements
