<br /> ( ) Portable ram ly swimming pool means a family' swimming pool
<br /> resting entirely above ground and designed to be easily dismantled,
<br /> stored and moved from one place to another.
<br /> (e) "Public wading pool" means an artificial body of water, with a controlled
<br /> water'Supply, not exceed ng twenty-four inches in depth and used
<br /> collectively by numbers of persons for wading.
<br /> (f) "Family wading pool" means an ant tic a body of water accessory to either
<br /> a Single-family Or two-family house, with a controlled water supply, with
<br /> any horizontal measurement being less than ten feet and Used or
<br /> intended to be used solely by the owner or essee of such dwelling house
<br /> or by his family Or by friends invited to use it without payment of an fee.
<br /> (1) "?ortable wading pool" means a family wadingpOol which Fay be
<br /> aismantled, stored or moved from one place to another
<br /> ( ) .P,ermanent wad ng. pool m.eans a family wading poo wh ch ~s built
<br /> ~e~mer upon or oe ow the ~evel of the ground and which is not
<br /> designed or intended to be readily dismantled, stored or moved
<br /> from one place to another
<br /> g) "p . ., .
<br /> ubhc spa means any public sw mining pool that is typically operated as
<br /> a smaller, higher temperature pool for recreational or nonmedical uses. As
<br /> used in this subsection:
<br /> (1) "Smaller" means less than 5,000 gallons in volume.
<br /> (2) "Higher temperature" means greater than ninety degrees
<br /> Fahrenheit.
<br /> (h) "Special use pool" means a public swimming pool containing flume slides,
<br /> wave-generating equipment or other special features that necessitat,e,
<br /> different design and ~afoty requirements. The term "sPecial use pool
<br /> does not include any water sli~Je or Wave-generating Pool at a public
<br /> amusement area which is licensed and inspected by the Ohio DePartment
<br /> of Agriculture pursuant to Ohio R.C. 1711.50 to 1711.57. As used in this
<br /> subsection:
<br /> (1) "Special features" includes, but is not limited to, a flume slide, a
<br /> playground-type slide, wave-generating equipment, a raindrop
<br /> fountain or other water attraction.
<br /> (2) "Public amusement area" means any pace at which one or more
<br /> water slides Or wave-generating pools are located, unless:
<br /> A. Payment for.using the water slide or wave-generating pool is
<br /> included in the fee charged for using a facility that is not
<br /> intended primarily for operation of amusement rides, as
<br /> de.fined in Ohio R.C. 1711.50, games or similar attractions.
<br /> FaCilities not intended primarily for the Operation of
<br /> amusement rides, games or similar attractions include, but
<br /> are not limited to, campgrounds, Municipal parks, hotels,
<br /> motels, apartment or condominium comPlexes, athletic clubs
<br /> and public swimming pOOls that also are used for swimming
<br /> or diving; or
<br /> B, The water slide or Wave-generating pool is part of a facility
<br /> that is not intended primarily for the operation o~
<br /> amusement ridesf games or similar attractions and either no
<br /> payment is required or a separate fee is charged for use of
<br /> the slide or pool.

<br /> ::IL72:L.03 CoNSTRUCT'J'ON PERMIT FORALL POOLS,
<br /> Before work is commenced on the construction of a public swimming pool, family
<br />pool or public wading pool or on any alteration, addition, remodeling or other
<br />imprOVement thereto, an aPp catiOn for a permit to construct and the plans and
<br />specifications and pertinent explanatory data hereinafter required shall be submitted to
<br />the CommissiOner of Building Inspection for ~pprovat. No part of the work shall be
<br />commenced until the Commissioner of Health and the Commissioner of Building
<br />[nspection have evidenced their approval by a suitable enddrsement upon such plans
<br />and specifications, and have granted a permit thereof.
<br />
<br /> 1721,04. FEES,
<br /> (a) Permits. The fee for the permit to construct a swimming pool shall be at
<br />the rate of four doli~-rs ($4.00) per 100 square feet, or fraction thereof, of the ground
<br />area occuPied by the pool structure, wth a minimum fee of twenty-five dollars
<br />($25.00). Such fee is in addit on to permit fees applicable to other structures which may
<br />be incidental to the pool, or Plumbing, seweting Or Wiring connections therewith.

<br /> (b) _Licenses. Annual fees for licenses to conduct, operate and maintain
<br />swimming pools, as required by Section 1721.05, are as follows:
