Please substitute for 2-07 <br />(Placed on 1st reading 1-2-07 <br />referred to R & O; Placed on 2® <br />reading 1-16-07) <br /> <br />ORDINANCE NO. 2-07 <br /> <br />FitzGerald, Madigan, Seelie. <br /> <br /> AN ORDINANCE to amend Chapter 557, Parades, of the Codified Ordinances of <br />the City of Lakewood for the PUrpose of requiring private entities who are organ zing <br />parades or special events in the City of Lakewood to pay a related expenses. <br /> <br />and WHEREAS, currently parade permEs encompass all special event including races; <br /> <br /> WHEREAS, during Such events, the City has an obligation to provide police <br />protection to participants in the event~ requiring on-duty officers to be assigned to the <br />event; and <br /> <br /> WHEREAS, depending on the route of such parade or special event, up to six or <br />seven on-duty Police officers must be assgned to direct traffic and provide other <br />protection during the event; and <br /> <br /> WHERES, in the interest of public safety, it is fitting to require the organizer of <br />the event to pay for personnel requ red as part of the permit fee to allow on-duty <br />personnel to remain available tO respond to emergency calls. Now, therefore <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That Chapter 557, Parades, of the Codified Ordinances of the <br />City of Lakewood, currently reading as follows: <br /> <br /> 557.01 DEFINITION. <br /> "Parade" means a group of five or more persons on foot, or three or more <br />vehicles or equestrians standing or moving Upon any public highway or public ground~ <br />Under common control or direction. This definition shall not include any governmental <br />officers or employees acting in their capacity as such~ or persons under their direction, <br />any militar~ organization, any funeral procession or any person while engaging in his <br />lawful employment in business or trade. <br /> <br /> 557~02 PERMIT REQUIRED. <br /> NO person shall parade or attempt to parade upon any public highway or public <br />ground Of the City unless and until such person first obtains the permit hereinatter <br />provided for. <br /> <br /> 557.03 DRIVING THROUGH PARADES. <br /> No driver of a vehicle shall drive between the vehic es or persons comprising a <br />parade when such vehicles or persOn are in motion and are conspicuously designated <br />as a parade, except upon direction of a police officer. <br /> <br /> 557.04 ISSUANCE OF PERMIT. <br /> Any person desiring to parade in or on any public highway or public ground of <br />the City for any purpose whatsoever shall, before parading, obtain from the Chief of <br />Police a permit therefor, which shall be ssued on y upon and after the approval of the <br />application therefor by the director of the department having contro Of the public <br />highway or public ground on which Such parade Or procession is to be held. <br /> <br /> 557.05 APPLICATION. <br /> Application for a permit shall be made n dup cate, each copy thereof to be <br />signed by the applicant and shall be in such form as the D rector of Public Safety shall <br />prescribe. The app cat on shall be filed with the Chief of Police at east five days prior to <br />the date upon which the parade is to be held. <br /> <br />557,06 COMPLIANCE WITH TERMS IN APPLICATION. <br /> <br /> <br />
