<br />(e) Final Acceptance. The City of Lakewood will grant Final Acceptance and <br />release the Guarantee when the following criteria are met: <br /> <br />(1) Final Stabilization is achieved, as approved by the City Engineer; <br /> <br />(2) All water quality BMPs are installed and functioning as per the <br />approved SWMP, as witnessed by the City Engineer during an as-built <br />inspection; <br /> <br />(3) An As-Built SWMP is approved by and filed with the City Engineer, <br />which As-Built SWMP shall include, at a minimum: <br /> <br />(4) Location and dimensions of all permanent BMPs; <br /> <br />(5) Maintenance requirements of each BMP; <br /> <br />(6) Identification of the entity responsible for long-term maintenance; <br />and <br /> <br />(7) Signature, seal and date approved by a Professional Engineer. <br /> <br />(f) An approved Inspection and Maintenance Agreement is filed with the <br />Building Department. The agreement must be signed by the contractor, City of <br />Lakewood and the private owner or homeowner's association who will take long-term <br />responsibility for the permanent BMPs. <br /> <br />1339.99 <br /> <br />PENALTIES. <br /> <br />(a) No person shall violate, or cause, or knowingly pe.rmit to be violated, any <br />of the provisions of this chapter, or fail to comply with any such provisions or with any <br />lawful requirements of any public authority made pursuant to this chapter, or knowingly <br />use or cause or permit the use of any lands in violation of this chapter or in violation of <br />any permit granted under this chapter. <br /> <br />(b) Whoever violates or fails to comply with any provision of this regulation is <br />guilty of a misdemeanor of the first degree and shall be fined no more than one <br />thousand doiiars ($1,000.00) or imprisoned for no more than one hundred eighty (180) <br />days, or both, for each offense. <br /> <br />¡ <br />. <br />I <br />l <br /> <br />(c) A separate offense shall be deemed committed each day during or on <br />which a violation or noncompliance occurs or continues. <br /> <br />33 <br />
