<br />(d) Upon notice from the City Engineer, or designated representative, that a <br />project site does not meet the requirements of this chapter, such work shall <br />immediately stop. Such notice shall be in writing and shall be either hand-delivered or <br />sent by certified mail, return receipt requested, to the owner or person responsible for <br />the development area, or person performing the work, and shall state the conditions <br />under which such work may be resumed; provided, however, in instances where <br />immediate action is deemed necessary for public safety or the public interest, the City <br />Engineer may require that work be stopped upon verbal order pending issuance of the <br />written order. <br /> <br />(e) The imposition of any other penalties provided herein shall not preclude <br />the City of Lakewood, by or through its Law Director and/or any of his or her assistants, <br />from instituting an appropriate action or proceeding in a court of proper jurisdiction to <br />prevent an unlawful development or to restrain, correct or abate a violation, or to <br />require compliance with the provisions of this regulation or other applicable laws, or <br />ordinances, rules or regulations or the orders of the City Engineer. <br /> <br />Section 2. It is found and determined that all formal actions of this Council <br />concerning and relating to the. passage of this ordinance were adopted in an open <br />meeting of this Council, and that all such deliberations of this Council and of any of its <br />committees that resulted in such formal action were in meetings open to the public in <br />compliance with all legal requirements. <br /> <br />Section 3. This ordinance is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the public peace, property, health, safety <br />and welfare in the City and for the usual daily operation of the City for the reasons set <br />forth and defined in the preamble to this ordinance, and provided it receives the <br />affirmative vote of at least five (5) of its members elected to Council, this ordinance <br />shall take effect and be in force immediately upon its adoption by the Council and <br />approval by the Mayor otherwise, it shall take effect and be in force after the earliest <br />period allowed by law. <br /> <br />Adopted: M~ 5, '200 $ <br /> <br />~Ç)~ <br />President of Council <br />rn~ 1. /!tzo <br />Cierk ctA:ouncii <br />d~.~ <br /> <br />Mayor -,' <br /> <br />Approved: ÆtZA/ú/ ~ ¿;¿ðtJJY <br /> <br />34 <br />
