PLEASE SUBSTITUTE FOR ORDINANCE N0. <br />PLACED ON 1ST READING & REFERRED TO <br />RULES & ORDINANCES COMMITTEE 11/19/07 <br />PLACED ON 2ND READING 12/3/07. <br />ORDINANCE N0. 95-07 BY: Antoniq, Bullock, Butler, Dever, <br />Madigan, Powers, Summers. <br />AN ORDINANCE, providing for the submission to the electors of the City of <br />Lakewood, an amendment to Article XIX. Section 2. Primary Elections of the Second <br />Amended Charter of the City of Lakewood, to move the date for primary elections to be <br />held in the City of Lakewood to the second Tuesday in September prior to each general <br />municipal election. <br />WHEREAS, conducting elections that are not regularly scheduled by the <br />Cuyahoga County Board of Elections is costly; and <br />WHEREAS, it is in the best interest of this body to be prudent trustees of the <br />public finances; and <br />WHEREAS, it is in the interest of the municipality, and democracy in general, to <br />encourage participation; and <br />WHEREAS, pursuant to the Second Amended Charter of the City of Lakewood <br />and the Constitution of the State of Ohio, Council has determined to authorize and <br />direct the submission to the electors of the City of Lakewood of the proposed change in <br />the date on which primary elections shall be held within the City of Lakewood, at the <br />general election to be held on Tuesday, November 4, 2008, which election is not less <br />than 60 nor more than 120 days from the effective date of this Ordinance. Now, <br />therefore <br />BE 1T ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br />OHIO; TWO-THIRDS OF THE MEMBERS OF COUNCIL, CONCURRING: <br />Section 1. That this Council hereby determines to authorize and direct the <br />submission to the electors of the City of Lakewood at the general election to be held at <br />the usual places of voting in the City on Tuesday, November 4, 2008, the proposed <br />amendment to Article XIX, Section 2, Primary Elections that will move the date that <br />primary elections are held in the City of Lakewood to the second Tuesday in September <br />prior to each general municipal election. <br />Section 2. That Article XIX, Section 2, Primary Elections of the Second <br />Amended Charter of the City of Lakewood be amended to read as follows: <br />ARTICLE XIX. ELECTIONS <br />Section 2. PRIMARY ELECTIONS <br />On the second Tuesday in September prior to each general <br />municipal election, primary elections shall be held for the purpose of <br />nominating persons, without regard to political parties, for election to <br />offices provided for by this Charter to be voted for at the next succeeding <br />regular municipal election. <br />The number of candidates for the office of Mayor and the four <br />Ward Councilmen at any regular election in the City shall be the two (2) <br />persons on the primary election ballot receiving the highest number of <br />votes at the primary election. The number of candidates for the office of <br />Council-at-Large at any regular municipal election in the City shall be the <br />six (6) candidates on the primary ballot receiving the highest number of <br />votes at the primary election. <br />In case there shall not be more than two persons who shall have filed <br />petitions for the office of Mayor or the four Ward Councilmen as provided <br />for in this Charter, then said persons shall be the candidates at the regular <br />
