<br />Antonio~ Bullock; Butler, Dever, <br />Madí?an, Powers, Summers. <br /> <br />Ordinance No. <br /> <br />26-08 <br /> <br />By: Antonio, Bullock, Butler, Dever, <br />Madigan, Powers, Summers. <br /> <br />An Ordinance to take effect immediately provided it receives the affirmative vote <br />of at least five (5) members elected to Council otherwise, it shall take effect and be in <br />force after the earliest period allowed by law, to enact new Section 1309.16, Storm <br />Water Management Fees, of the Codified Ordinances of the City of Lakewood for the <br />purpose of setting and collecting fees for permits and work associated with Storm <br />Water Management by the City of Lakewood. <br /> <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect at the earliest date possible as set forth in ARTICLE III, SECfONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of municipal departments in that this legislation <br />is necessary to charge fees required in the new Lakewood Codified Ordinances Chapter <br />titled Storm Water Management. Now therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That Section 1309.16, Storm Water Management Fees, of the <br />Codified Ordinances of the City of Lakewood, is hereby enacted to read as follows: <br /> <br />The following fees must be deposited with the City of Lakewood Building <br />Department prior to the commencement of soil disturbing activities: <br /> <br />(a) Abbreviated SWP3 <br /> <br />(1) Review/Inspection Reserve Fee* <br /> <br />$ 750.00 <br /> <br />(2) Control Performance Bond** <br /> <br />1,500.00 <br /> <br />(b) Comorehensive SWP3 <br /> <br />(1) Review/Inspection Reserve Fee* <br />(per disturbed whole acre, Example: 1.25 Acre <br />disturbance = $1500) <br /> <br />750.00 <br /> <br />(2) Erosion Control Performance Bond** <br />(per disturbed whole acre) <br /> <br />1,500.00 <br />
