purchaser or if the statements are not made on the main label of suchcontaineq <br />(3) It is wlored or flavored artificially and if a statement to that effect is not marked or printed on the container thereof; <br />(4) The bottle or receptacle containing it or its label bears any statement, design or device regarding the ingredients of <br />the substance contained therein, which statement, design or device is false or misleading in any particular. <br />(5) It is labeled or branded so as to appear to be a natural product when in fact it contains any added ingedients not <br />contained in the article in its natural state. <br />(6) Any fraudulent or exaggerated statement regarding the healthful or physiological properties of the article or <br />ingredients therein appears on the container or any label or wrapper attached thereto or in which the same is wrapped. <br />1749.18 LABELING OF FOOD CONTAINING SODIDM BENZOATE OR <br />SULPHUR DIOXIDE.. <br />No person, firm or wryoration shall prepare, manufacture, sell, keep for sale, deliver, or suffer or permit to be prepared, <br />manufactured, sold, kept for sale or delivered any food of food product which contains any sodium benzoate or sulphur dioxide unless it <br />is so labeled and unless the main label on the container or wrapper thereof contains the words "Prepared with Benzoate of Soda" or <br />"Prepared with Sulphur Dioxide, " as the case maybe. The above labeling shall be done in plain gothic type a[ least one-fourth as large as <br />the largest letter on the main label, in a color which contrasts with the background, so that the words can be easily read. <br />]749.19 STANDABDS OF PURITY. <br />The standards of purity for food products for the purpose of this chapter shat) be those standards fixed by the Federal Food, <br />Drug and Cosmetic Act, as amended, and General Regulations, Title 21, Part 1 ofthe Code of Federal Regulations. <br />170.9.20 CIDER OR APPLE VINEGAR. <br />No persoq firm or corporation shall prepare, manufacture, sell, keep for sale, deliver or suffer or permit to be prepared, <br />manufactured, sold, kept for sale or delivered any vinegar, under the name of cider vinegar, apple vinegar or any compounding of the <br />word "cider" or "apple" as the name or part of the name of the vinegar unless the vinegar is the product made by the alcoholic and <br />subsequent acetous fermentations ofthe juice of apples, and does not contain any foreign substance, drugs or acids, and unless 100 cubic <br />centimeters thereof, at a temperature of twenty degrees centigrade, contains at least Four grams of acetic acid, at least one and six-tenths <br />grams of apple solids of which not more than fifty percent are reducing sugars, and at least twenty-five.one~~hundredths of one gram of <br />apple ash; and unless the watervsoluble ash from 100 cubic centimeters of the vinegar, at a tempcmmre of twenty degrees centigrade, <br />contains at lease ten milligrams of phosphoro sold and requires at least thlrry anhic ceutimeters of decinormel acid to ueufralize its <br />alkaliniy <br />1749.21 WINE OR GRAPE VINEGAR. <br />No person, firm or corporation shall prepare, manufacture, sell, keep for sale, deliver, or suffer or permit to be prepared, <br />manufactured, sold, kept For sale or delivered any vinegar under the name of wine vinegar or grape vinegar unless such vinegar is the <br />product made by the alcoholic and subsequent acetous fermentations of the juice afgrapes; and unless 100 cubic cenfuneters thereof, at a <br />temperature of twenty degrees centigrade, contains at leas[ four grams of acetic acid, at least one gram ofgrapesolids and at least thirteen <br />hundredths of one gram of grape ash. <br />1749.22 MALT VINEGAR <br />No persoq firm or corporation shall prepare, manufacNre, sell, keep for sale, deliver or suffer or permit to be prepared, <br />manufactured, sold, kept for sale or delivered any vinegar under the name of malt vinegar unless such vinegar is [he product made by the <br />alcoholic and subsequent acetous fermentations, without distillation, of an infusion of barley, malt or cereals, the starch of which has <br />been converted by mall, and unless 100 cubic centimeters thereof, at a temperature of twenty degrees centigrade, contains at leas[ four <br />grams of acetic acid, at least two grams of solids, and at least two-tenths of one gram of ash, and unless the water-soluble ash from 100 <br />cubic centimeters of the vinegar, at a temperature of twenty degrees centigrade, contains at least nine milligrams of phosphoric acid <br />which requires at least four cubic centimeters of decinormal acid to neutralize its alkalinity <br />1749.23 DISTH.LED VRVEGAR <br />Alf vinegar made by fermentation and oxidization, without any distillation process, shall be branded Fermented Vinegar, with <br />the name of the fruit or substance from which it is made. All vinegar made wholly or in part from distilled liquor shall be branded <br />Distilled Vinegar, and all such distilled vinegar shall be kept free from coloring matter, except that imparted4o it by the regular process <br />of distillatioq and shall contain not less than four percent by weigh[ of absolute acetic acid. All vinegar shall be made wholly from the <br />fruit or grain or other substance from which it is represented to be made, and shall contain no foreign substance. However, this shall not <br />be construed to prohibit the use of such amount of spices as are necessary for flavoring provided such spices do not color the vinegar <br />1749.24 FOREIGN INGREDIENTS IN VINEGAR <br />No persoq firm or corporaton shall prepare, manufacture, sell, keep for sale, deliver, or suffer or permit to be prepared, <br />manufactured, sold, kept far sale or delivered any vinegar which contains any lead, copper, sulphuric acid or other mineral acid, or any <br />acid not found in natural fruit products or any preservative or coloring or any ingredients injurious to health; and unless every cask, <br />barrel, keg or other container of such vinegar shall be plainly and distinctly marked with the name and residence of manufactures <br />together with the true brand of the vinegar contained m such cask, barrel, keg or other container as described in this chapter <br />1749.25 ADULTERATION OF MEAT AND FISH. <br />(a) As used in this section: <br />(1) "Meat or meat product" means [he flesh or viscera of cattle, calves, sheep, swine, goats, rabbits, deer or <br />other game, chickens, turkeys, ducks or other fowl, and any edible product of same. <br />(2) "Fish or fish products" means any animal taken from a natural habitat of salt or fresh water for the purpose <br />ofhuman consumption, and any edible product of same. <br />(b) No person, firm or corporation shall prepare, manufacture, sell, keep for sale, deliver or suffer or permit to be <br />prepared, manufactured, sold, kept for sale or delivered any meat or meat product, or fish or fish product which wnlains any sodium <br />sulphite, any coloring matter, any preservative harmful to human health, any substance designed to conceal inferiority or damage to the <br />product or to make the product appear better or of greater value than it really is, or any deleterious substance of any kind and for <br />whatever pupose used. Nothing in this section shall be deemed to prohibit the use o£ common sodium chloride salt, or monosodium <br />glutamate, in or oq or prohibit the smoking of meat or meat products, and fish or fish products. <br />1749.26 SEIZURE OF GOODS. <br />Except when anyadulterated or misbranded product, as defined in this chapter, is in the possession of a manufacturer or <br />wholesaler at the time such product is seized or collected, such manufacturer or wholesaler shall not be liable for prosecution for the <br />17 <br />
