regarding its or their action, which statement, design or device, shall be false or misleading in any particular;
<br />Fourth. If the package containing it or any label thereon bears or contains any statement, design or device regarding Ne
<br />curative or the thempeufic effect of such article or any ofthe ingredients or substances contained therein which is false and fraudulent;
<br />Fifth: If a box, bottle or package containing virus, therapeutic serum, toxin, antitoxin or analogous product, fails to bear on the
<br />outside thereof conspicuously, clearly and legibly set forth in English, the proper name ofthe substance therein contained, the name and
<br />address of the person, firm or corpomtion by whom or by which the substance has been prepared, the date beyond which the substance
<br />cannot be reasonably expected to produce the result or results for which it has been prepared, and (if such license shall have been
<br />obtained) the United States license number of the establishment in which the substance has been prepared; and, in the case of diphtheria
<br />and tetanus antitoxin, if the box, bottle or package containing such antitoxin shall fail [o bear on the outside thereof, conspicuously,
<br />clearly and legibly set forth in.English, the value ofthe wntenis therefor as an antitoxin, which value shall be measured according to and
<br />stated in the terms ofthe standard fixed by the United States Crovernment.
<br />In the case of food:
<br />First: If it be an imitation of, or offered for sale under the distinctive name of, another article;
<br />Second. ff it be labeled or bmnded so as to deceive or mislead the purchaser, or purport to be a foreign product when not so, or
<br />if Ne contents of the package as originally put up shall have been removed in whole or in part end any other substance shall have been
<br />placed in such package;
<br />Third: If in package form the quantity of the contents be not plainly and conspicuously marked on [he outside of the package
<br />in terms of weigh[, measure or numerical count
<br />Fourth: If the package containing it nr the label shall bear any statement, design or device regarding the ingredients or the
<br />substances contained therein, which statements, design or device shall be false or misleading in any particular
<br />1749.10 INJURIOUS SUBSTANCES IN ICE CREAM.
<br />No person, firm or corpomtion shall prepare, manufacture, sell, keep for sale, deliver or suflCr or permit to be prepared,
<br />manufactured, sold, kept for sale or delivered, any ice cream, sherbet or ices which contain any sulphurous acid, sulphur dioxide or
<br />sulphites, benzoic acid or benzoates, boric acid or borates, salicylic acid or salicylates, phosphoric acid or added phosphates,
<br />formaldehyde, hydrofluoric acid or fluorides, fluoborates, fluosilicates or other fluorine compounds, dulcin, gluciu, saccharin, alum,
<br />compounds of copper, betanaphthol, hydronapthol, abrastol, asaprol or any meta( or added metallic salt or coloring matter other than
<br />those authorized under Section 1749..07, or any deleterious flavoring matter or flavoring matter not true to name or any substance of any
<br />sort injurious to health.
<br />1749.11 FRAUDULENT USE OF COLORS IN ICE CREAM.
<br />No person, firm or corporation shall prepare, maw£acture, sell, keep for sale, deliver or suffer or permit to be prepared,
<br />manufactured, sold, kept for sale or delivered any ice cream, sherbets or ices which contain any substance, not eggs, which gives the
<br />appearance of eggs, or of more eggs than are really contained therein; or any ice cream which has any substance contained therein which
<br />gives the appearance of fruit or more fruit than is actually contained therein; or any ice cream which has any substance added for any
<br />fraudulent or misleading purpose whatsoever. Howeveq nothing in this section shall prohibit the use of those colors authorized under
<br />Section t749.07 when not used in a manner whereby damage or inferiority is concealed or the product made to appear better or of greater
<br />value than it really is.
<br />1749.12 ICE CREAM STANDARDS.
<br />No person, firm or corporation shall prepare, manufacmre, sell, keep for sale, deliver or suffer or permit to be prepared,
<br />manufacured, sold, kept for sale or delivered any ice cream, sherbet or ices which are falsely labeled or branded or misrepresented in any
<br />way as to the name under which they are sold or offered for sale, or as to the name and address of the manufacturer thereof, or any ice
<br />cream which contains glucose, starch, cotton seed oil, corn ail or mare than one~~half of one percent of gelatin, or any cheaper or inferior
<br />substance, or less than eight percent of butterfat, except when ten percent of the ice cream by weight consists of fruit or nuts used for the
<br />purpose offlavoring, in which case the amount of butterfat may be reduced to two percent.
<br />1749.13 FRUIT JELLIES; CONTENTS.
<br />No person, firm or corporation shall prepare, manufacture, sell, keep for sale, deliver or suffer or permit to be prepared,
<br />manufactured, sold, kept for sale or delivered any preserve, jam, jelly or fruit butter which contains any other fmit or fruit product than
<br />that after which it is called,
<br />1749.14 INJURIOUS SUBSTANCES IN JELLIES.
<br />No person, firm or corporation shall prepare, manufacture, sell, keep for sale, deliver or suffer or permit to be prepared,
<br />manufacured, sold, kept for sale or delivered any product which contains any added phosphoric acid or any mineral acid, saccharin,
<br />dulciq gluciq benzoic acid or sodium benzoate, hetanaphthol, abmsthol, asaprol, fluorides, fluoborates, fluosilicates or other fluorine
<br />compounds, formaldehyde or any chemical preservative, any gelatin, agar, added starch, arsenic, tin, lead or any added coloring matter,
<br />unless it is such as authorized under Section 1749.07
<br />1749.15 LABELING JELLIES
<br />No persdn, firm or wrporation shall prepare, manufacture, sell, keep for sale, deliver or suffer or permit to be prepared,
<br />manufactured, sold, kept for sale or delivered, any jelly, jam, fruit, preserves, fruit symp, fruit butter, marmalade or other fruit product
<br />which contains any added color of any sort or glucose, unless the product be labeled and the presence of such added color or glucose be
<br />declared, marked or printed on the main labet of the container or receptacle in plain gothic letters at least one-fourth as large as the
<br />largest letter on the label in colors which sharply conhast with the material upon which the marks are made so as to be easily read by any
<br />purchaser
<br />1749,16 ADULTERATION OF NONALCOHOLIC DRINKS.
<br />No person, firm or corporation shall prepare, manufacNre, sell, keep for sale, deliver or suffer or permit to be prepared,
<br />manufactured, sold, kept for sale or delivered any nonalcoholic drink which conmins any boric acid or bomtes, salicylic acid or
<br />salicylates, fotmaldehydes, sulphurous acid or sulphites, hydrofluoric acid or benzoates, fluoborates, fluosilicates or other fluorine
<br />compounds, saccharin, cocaine,. morphine or any added habit forming drugs, dulcin, gluciq saponin or soap bark, betanaphthol,
<br />hydronaphthol, abrasthol, compounds of copper, pyroligneous acid, methyl alcohol or any added color, except those authorized under
<br />Section 1749.07, or any other substances deleterious to health.
<br />1749.17 MISBRANDING OF NONALCOHOLIC DRINKS.
<br />No person, flan or corporation shall prepare, manufacture, keep for sale, sell, deliver or suffer or permit to be prepared,
<br />manufacNred, sold, kept for sale or delivered any nonalcoholic beverage which is misbranded within the meaning ofthis chapter For the
<br />purpose ofthis chapter, a nonalcoholic drink shall be misbranded if
<br />(1) It is so marked or tagged so as to deceive or mislead any purchaser;
<br />(2) Any statement required by this chapter to be printed or marked on the container [hereof, cannot be easily read by any
