which the business for which the license is granted is conducted do not comply in all respects with the provisions ofthis Sanitary Code <br />and with all laws and ordinances applicable to such premises and the use to which they me put, or if any false statement has been made <br />by the applicant in eomecCion with the issuanoe of Bach licause or if [he owner of suoh busiuass or the agent of tha owner does anything <br />or causes anything to be done or omits to do anything or causes the omission of anything required or prohibited by this Sanitary Code or <br />by any other law or ordinance relating to such business or such pmmises, <br />1751.10 FOOD SERVICE OPERATION; LICENSE FEE. <br />Notwithstanding other provisions ofthis chapter, the license fee chargeable, and which shall be paid for a license to conduct a <br />food service operation as defined and provided in Ohio R.C. Chapter 3732, shall be as provided in Ohio R.C. 3732.04. <br />1751.11 DISPLAY OF LICENSE; WOLATION. <br />No person shall operate any bakery, confectionery, cannery, packing house, candy factory, ice cream factory, restauranS hotel, <br />coffee house, chop house, tea room, grocery, meat mazkeS sausage factory or delicatessen store or any other place in which food is <br />prepared, produced, manufactured, packed, stored or served for sale, or any basket, wagon or other vehicle, hand steamer or street stand <br />from which food is vended and peddled, unless a license duly issued, as hereinbefore provided, shall then be in force, and unless such <br />license shall at all times 6e displayed in a conspicuous place upon the wall within and close to the outer entrance ofthe premises where <br />such business is conducted or, in the case of a vending or peddling business, in a conspicuous place on the side ofthe vehicle, basket or <br />stand in which such business is conducted. Each day's operation in violation ofthis chapter shall constitute a separate offense punishable <br />as provided in Section 1701.99 <br />CHAPTER 1753 <br />Sale oflrradiatad Foode <br />1753.01 DEFINITIONS. <br />(a) "Food" means fruits, vegetables, meats, poultry, eggs, dairy products and other natural and processed products <br />offered for sale for human or animal consumption. <br />(b) "Irradiated food" means any food treated with ionizing radiation from radioactive sources, x~rays or electron beams, <br />and includes any food which contains an ingredient that has been irradiated. However, if the irradiated ingredients of any food consist <br />solely of spices which have been so treated, such food shall not be deemed an irradiated food on accountof such irradiated spices <br />1753.02 SALE OF IRRADIATED FOOD PROHIBITED; EXCEPTION. <br />No merchant, broker or processor shall knowingly sell, offer for sale or expose for sale an irradiated food, except as otherwise <br />provided in this chapter, whether or not such food is deemed to have been adulterated under provisions of these Codified Ordinances. It <br />shall not be unlawful under this chapter for any merchant, broker or processor to knowingly sell, offer for sale or expose for sale an <br />irradiated food, to a hospital, medical cliniq physician or physician's office for use as part of a medical regimen in the care or treatment <br />of persons with immune system deficiency or other diseases, provided the irradiated food is packaged with or is accompanied by a <br />warning label stating that it is intended for medical use only by such persons upon a physician's advice. <br />1753.03 APPLICATION OF CHAPTER. <br />The provisions of this chapter shall not apply to irradiated foods purchased prior to the effective date ofthis section. <br />1753.04 EFFECTIVE DATE. <br />This chapter shall take effect, for enforcement purposes, on the 120th day after it shall have taken effect under the Second <br />Amended Chazter of the City <br />1753.99 PENALTY. <br />Whoever violates any ofthe provisions ofthis chapter is guilty of a misdemeanor ofthe third degree. If the offender has been <br />previously convicted of a violation ofthis chapter, a second or subsequent offense shall constitute a misdemeanor of the second degree. <br />CHAPTER 1757 <br />Moat lvspection <br />1757.01 DEFINITION. <br />As used in this chapter, "meat or meat product" means [he flesh or viscera of cattle, calves, sheep, swine and goats, and any <br />edible product of same, <br />1757.02 INSPECTION REQUIRED. <br />No person shall dispose of, sell, offer for sale or have iahis possession for sale, whether a[ wholesale or retail, any meat of <br />meat products within the City, unless such meat or meat products have been inspected by the Ohio State Department of Agriculture or <br />bear the inspection mark ofthe Ohio State or Federal Department of Agriculture. <br />1757.99 PENALTY. <br />Whoever violates any provision ofthis chapter shall for a first offense be fined not more than fifty dollars ($50.00), and for a <br />second or subsequent offense shall be fined not more than one hundred dollars ($100.00) or imprisoned not more than ninety days, or <br />both. Each sate or attempted sale in violation of this chapter shall constitute a separate offense. <br />CHAPTER 1767 <br />Killing and Selling of Fowl and Game <br />1767.01 DEFINITIONS. <br />(a) "Poultry" and "fowl", as used in this chapter, are synonymous, and mean and include chickens, ducks, turkeys, geese <br />and any other birds intended for human consumption. <br />(b) "Game" means and includes rabbits, muskrats, squirrels, opossums and any other similar small animals, whether <br />domesticated or wild, which are slaughtered and/or dressed for sale and/or human consumption. <br />(c) "Place for the killing of fowl or game" means any building, structure, place, establishment or premises used for killing of <br />fowl or game for the purpose of sate or for any other purpose. This term includes all rooms used for flicking or dressing and rooms used <br />for the storage of other articles used in slaughtering of such fowl or game. l'he term does no[ include any place used by an individual for <br />the killing of poultry, fowl or game for consumption by himself or his immediate family living on the premises where such poultry, fowl <br />or game are killed, <br />19 <br />
