1767.02 UNFIT POULTRY.
<br />No person, firm, corporation or association shall sell, deal in, give away, exchange, or have in possession in the City any
<br />poultry with tumors, downers, tuberculosis, gaps, swollen heads or eyes, or any poultry which is badly bruised or with any other diseases
<br />or defects which render such poultry unfit for human consumption. All such poultry found to be diseased, decomposed or unfit for
<br />human consumption shall be condemned, seized and destroyed.
<br />1767.03 SLAUGHTER AND INSPECTION OUTSIDE CITY.
<br />No person shall bring within the limits of the City, to be sold or offered for sale therein, any poultry from any slaughter house
<br />located outside the limits of the City of whose owrteq lessee or occupant has not substantially conformed to this Sanitary Code in the
<br />killing, handling, keeping or selling ofsuch poultry.
<br />Where such poultry is slaughtered outside of the City the Commissioner of Health may require a certificate from the City or
<br />County Health Commissioner where such plant for slaughtering of poultry is located, showing that such plant is operated in a clean and
<br />sanitary manner in conformity with the provisions ofthis Sanitary Code regulating the killing, handling and keeping of poultry. If the
<br />Health Commissioner ofsuch City or CowTy will not famish such certificate, the Commissioner of Health may require an inspection to
<br />be made ofsuch premises located outside of the City and the methods of slaughtering, handling and keeping poultry at such premises,
<br />before permitting such poultry to be brought into the City The reasonable costs, including tmvel expense, ofsuch inspections, shall be
<br />paid to the CiTy by the persons whose plants are inspected.
<br />1767.04 PERMIT TO SELL POULTRY.
<br />No farmer shall bring into the City, have in his possession, sell or offer for sale any live poultry without first having obtained a
<br />permit from the official charged with [he enforcement of this Sanitary Code. Such permit shall be issued only after such farmer shall
<br />make an affidavit stating that all poultry to be sold by him in the City will have been entirely raised by himself on his own farm from
<br />eggs or day old chickens. Such permit shall be revocable by the official charged with the enforcement ofthis Sanitary Code if any poultry
<br />other than that described in the affidavit, or if any poultry unfit for human consumption, is sold, offered for sale, or brought into the City
<br />for sale by such farmer
<br />1767.05 RETAIL SALE OF POULTRY.
<br />A71 poultry sold in the City shall be sold by weight only No poultry that is diseased, badly bruised, decomposed or otherwise
<br />unfit far human consumption shall be cut up for retail sale.
<br />1767.06 CUTTING AND MARKING; PAYMENT FOR INSPECTION;
<br />SALE AT WIiOLESALE.
<br />No cut up poultry, fowl or game shall be sold at retail unless such cutting has been done in the presence of an inspector of the
<br />Division of Public Health or in the presence of an inspector of a governmental unit using standards subs[antia(ly equivalent to those
<br />provided by this Sanitary Code. Such cutup poultry, fowl or game shall either be sold to the customer in the original package bearing the
<br />name and address ofthe plant where such poultry, fowt or game was cut up, the net weight, and the inspection stamp or brand affixed by
<br />the inspector at the time of the original inspection, or each individual piece ofsuch poultry, fowl or game shall bear an inspection stamp
<br />or brand affixed by or under the immediate supervision of the inspector supervising such cutting, showing the establishment number of
<br />the plant where such poultry, fowl or game was cutup, unless the sale to the ultimate consumer is made in the presence of the inspector
<br />assigned to the inspection ofsuch cutup poultry, fowl or game.
<br />When such special inspection is rendered by an inspector of the Division of Public Health the person requiring such service
<br />shall pay to the City for such services in accordance with establishetl rate schedules of the Division of Public Health. Nothing in this
<br />section shall be held to prevent the cutting up of fowl or game for a customer when done in the presence ofsuch customer.
<br />No person, firm, corporation or association shall cut up ary diseased, decomposed or badly bruised poultry, fowl or game, or
<br />any poultry, fowl or game which is otherwise unfit for human consumption, for sale at wholesale to institutions, hospitals or places
<br />buying in wholesale quantities for use on their own premises.
<br />1767.07 OVER-CROPPED POULTRY; SEPARATION FROM OTHER
<br />FOOD PRODUCTS.
<br />No cut up or canned poultry, fowl or game shall be brought into the City unless from plants under City inspection or under the
<br />inspection of a governmental unitwith standards substantially equivalent to those contained in this Sanitary Cade.
<br />No over-cropped poultry shall be sold, offered for sale or displayed for sale. Poultry weighing two and one~half pounds or
<br />more [hart a crop or more than two ounces shall be deemed to beover-cropped and poultry weighing less than two and one~fialf pounds
<br />with a crop ofmore than one ounce shall bedeemed to beover-cropped.
<br />No person who sells live poultry, fowl or game at wholesale or retail shall store, keep, transport or sell any live poultry, fowl or
<br />game on Ore same truck with any fruit, vegetables or other food products.
<br />1767.08 SALE AND DELIVERY; LICENSE REQUH2ED.
<br />No person shall sell any dressed poultry, fowl or game at retail from wagons, pushcarts or other vehicles and no dressed
<br />poultry, fowl or game shall be delivered to any house except by a person, firm, corporation or association having a current Lakewood
<br />Food Vendor's License.
<br />1767.09 SANITATION IN SLAUGHTER PLACE; STORAGE LIMITATIONS.
<br />No place used for the killing of fowfor game shall be so used or established unlesssuch place is maintained in a sanitary way
<br />and condition. No fowl or game shall be kept Orerein for a period of over twenty-four hours.
<br />1767.10 STRUCTURAL REQUIREMENTS OF SLAUGHTER PLACE.
<br />The building used for slaughter and flicking or dressing shall be either a separate building without a direct connection to the
<br />place where live fowl or game are kept or a separate room with outside entrance and outside light and ventilation without arty direct
<br />connection with any other room, enclosed place or building, except that a small opening, not greater than two feet square provided with a
<br />sel&closing door may be located between the poultry slaughtering room and the sales room, provided that such opening shall be not less
<br />than four feet above the floor level of each of the connecting rooms and shall 6e used only for handling fowl or game back and forth
<br />between such rooms.
<br />In the case of places having mare than 100 fowl or game on hand at any one time, separate slaughtering and flicking or
<br />dressing rooms shall be provided, separated by an impervious partition and connected only by one or more self-closing doors. Both such
<br />rooms shall meet the specifications for slaughtering rooms, and neither room shall have less than 100 square feet of floor space.
<br />Every room used for the slaughtering, flicking or dressing of fowl or game shad he of waterproofed cement, the or other similar
<br />impervious material which must he washed after each day's use. All such wags and ceilings shall be of smooth construction, free from
<br />projections, crevices and cracks and all such walls and ceilings shall be painted, whitewashed, scraped, scrubbed or cleaned whenever
<br />ordered by the official charged with the enforcement of this Sanitary Code. Nothing in this section shall be held to prohibit Ote use of
