<br />1701.99 PENALTY.
<br />Whoever violates any of the provisions of this Sanitary Cade for which no penalty is otherwise providedshall be fined not less
<br />than five dollars ($5.00) nor more than two hundred dollars ($200.00) or imprisoned for not more than sixty days, or both, and shall
<br />stand committed until such fine be paid or sentence served, or until otherwise discharged by due process of law Each day's violation
<br />shall constitute a separate offense.
<br />CHAPTER 1703
<br />Definitions
<br />1703.01 MEAMNG OF WORDS AND PHRASES.
<br />For the purpose ofthis code certain words and phrases are defined as follows:
<br />1703.02 BASEMENT.
<br />"Hasement" means a story of a building located partly below the adjoining ground, but having at least one-half of its height
<br />above the highest level ofthe adjoining ground.
<br />1703.03 BOTTLED BEVERAGE.
<br />"Bottled beverage" means any nonalcoholic drink, and any mineral waters, whether Hamra] or artificial.
<br />1703.04 BOTTLING WORKS.
<br />"Bottling works" means any place where nonalcoholic drink of any kind intended for sale for human consumption is prepared,
<br />mixed, cooked, bottled or packed.
<br />]703.05 CELLAR.
<br />"Cellar" means a story having more than one~~half of its height below the highest level ofthe adjoining ground.
<br />1703.06 COMMUMCABLE DISEASE.
<br />"Communicable disease" means a disease which can be communicated or transmitted by one person or animal to another by
<br />any means whatsoever
<br />1703.07 COURT.
<br />"Court" means an open space bounded on one or more sides by the walls of a building, the bottom of which open space is
<br />either above or below the ground level ofthe lot on which such building is located, and which is clear, open and unobstructed from the
<br />bottom thereofto the sky
<br />1703.08 DRUG.
<br />"Drug" means and includes all medicines and preparations recognized in the United States Pharmacopoeia, or in the National
<br />Formulary or its appendix, or in other recognized standard works for internal or external use, and any substance or mixture of substances
<br />whatsoever manufactured, sold or given away for use in the treatment of any disease of either man or animal.
<br />1703.09 DWELLING.
<br />"Dwelling" means any building or any part thereof which is wholly or partly used or intended to be used for living or sleeping
<br />by human occupants.
<br />1703.10 DWELLING ROUSE.
<br />"Dwelling house" means any building or portion of any building used as a place of human habitation other than a tenement
<br />house and lodging house.
<br />1703.11 DWELLING UNIT.
<br />"Dwelling unit" means any room or group of rooms, or any part thereof, located within a dwelling and forming a single
<br />habitable unit with facilities which are used or intended to be used for living, sleeping, cooking and eating.
<br />1703.12 EXTERMINATION.
<br />"Extermination" means the control and elimination of insects, rodents or other pests by eliminating their harborage places, by
<br />removing or making inaccessible materials that may serve as their food, by poisoning, spraying, fumigatlng, trapping or by any other
<br />methods approved by the official charged with the enforcement of this Sanitary Code.
<br />1703.13 FOOD.
<br />"Food" means and includes all substances except dings used or intended to be used for human consumption, including eggs,
<br />flavoring extmcks,.fish, meat, vegetables, fruit, water, beverages, confections, condiments, preservatives, chemicals and colors, whether
<br />mixed or combined, used or manufactured or sold for use in food.
<br />1703.14 GARBAGE, REFUSE, LITTER
<br />"Garbage", "refuse" or "litter" means [he animal and vegetable waste resulting from the handling, preparation, cooking and
<br />consumption of food, or the substances as se[ forth in Section 521.08 of the General Offenses Code; or solid waste accumulations
<br />consisting of garbage, household trash, yard debris and business trash; or all discarded man-made materials including but not limited to,
<br />waste materials, building materials; trash, refuse and yard debris.
<br />1703.15 HABITABLE ROOM.
<br />"Habitable room" means a room or enclosed floor space, used or intended to be used for living, sleeping, cooking or eating
<br />purposes, excluding bathrooms, water close[ compartments, laundries, pantries, foyers or communicating corridors, closets and storage
<br />spaces.
<br />1703.16 INFESTATION.
<br />"Infestafion'"means the presence, within or around a dwelling, of any insects, rodents or other pests.
