1769.04 ANIMAL ENCLOSURES; LIMITATIONS ON RAISING FOWL.
<br />No rabbit hutch, goat pen, chicken coop, mnway yard or other place for the keeping ofany rabbit, goat, chicken, goose, turkey,
<br />common pigeon other than a homing pigeon, or fowl of any kind shall be maintained or suffered to exist in the City No live rabbit,
<br />chicken, duck, goose, turkey, common pigeon other than a homing pigeon or other fowl shall be raised or kept in the City, except khat
<br />fowl for the purpose ofkilling or sale in the ordinary course of business may be kept in crates, provided that.
<br />(a) Every such crate is maintained in a clean condition;
<br />(b) Every such emte is kept upon a watertight floor or pavement that is thoroughly flushed with water daily; and
<br />(c) No crate containing or used to contain live fowl is kept in the same room in which Food other than live fowl is
<br />prepared, placed, kept or sold.
<br />1769.05 MAINTENANCE OF STABLES.
<br />No stable or other place for the keeping ofany horse, mule ordonkey shall exist or be pemdtled to exist unless such stable or
<br />other place is maintained in a clean wndition, free from any accumulation of filth, garbage, mbbish or other waste.
<br />1769.06 REMOVAL AND DISPOSAL OF DEAD ANIMALS.
<br />Every person, firm or corporation owning or having the possession or charge ofany dead animal not proper for food, and any
<br />occupant or owner oP premises on which there is any dead animal no[ proper For food, shall at once remove such animal or cause the
<br />same to be removed to a fertilizer or reduction plant equipped properly to dispose of dead animals.
<br />1769.07 DISEASED ANIMALS.
<br />The Division of Public Health, upon obtaining information as to the existence of a communicable disease in any animal, shall
<br />cause the destruction, removal or isolation of such animal.
<br />1769.08 PLACES USED FOR THE SALE OF ANIMALS AND BHH)S..
<br />(a) No building or portion of any building shall be used for a place to keep for sale any dogs, cats, rodents, birds, or
<br />other animals uriless such building or portion thereof is separated from a place of human habitation, or from a place where food is
<br />prepared, placed, kept or sold, by a wall or ceiling which contains no openings, and unless such place is maintained in a clean condition
<br />and free from any accumulation of filth, garbage, rubbish or other waste. Such wall or ceiling may contain a window or skylight provided
<br />such window or skylight is not operable.
<br />(b) No person shall permit such building or portion thereofto become anuisance by
<br />reason of odors, noises, or other causes.
<br />(e) No person shall display, sell, keep for sale or offer for sale, any dog, cat, rodent, bird, or other anima[ which is not
<br />kept or maintained in brooder facilities, pen, cage or other housing adequate to safeguard the health of [he animals as determined and
<br />approved by the Health Commissioner ofthe City

<br />Weeds
<br />1775.01 WEED OR TALL GRASSREMOVAL.
<br />(a) The owner, occupant or person having the charge or management ofany lot or parcel of land situated within the CiTy,
<br />whether the same be improved or unimproved, vacant or occupied, within forty-eight hours written notice [o do so, shall cut or deshoy,
<br />or cause to be cu[ or destroyed, any noxious or poisonous weeds, including but not limited to Russian, Canadian or common thistle, all
<br />wild IetNCe, wild mustard, wild parsley, ragweed, milkweed, chickweed, wild garlic, quack Bass, dodders, wild carrot, common cockle,
<br />docks, chicory or tall grasses growing upon such lot or parcel of land, and prevent the same from blooming or going to seed, or
<br />exceeding a height of six inches, or spreading pollen which may be hazmfut to human health.
<br />(b) If the owner, occupant or person having the charge or management of any lot or parcel of laud does no[ cu[ or
<br />destroy, or cause to be cut or destroyed, noxious weeds or grasses as provided herein, the Director of Human Services. or designee is
<br />authorized to cause to be cut or destroyed such noxious weeds or grasses.
<br />(c) When any such noxious weeds or grosses are cut or destroyed by the City, as provided herein, then after such work is
<br />performed, the City shall give five days' notice by regular mail to the owner, occupant or person having the charge or management of
<br />such lot or parcel of land, at his known address, to pay the cost of such cutting or destroying of noxious weeds or grasses, which notice
<br />shall be accompanied by a statement of the amount of cost incurred. If the same is not paid within thirty days after the mailing of the
<br />notice, such amount may be certified to the CounTy Auditor for collection as other taxes and assessments are collected in accordance with
<br />Ohio R.C. 731.54, or the City may seek recovery of such vests by civil action against the property owner involved,
<br />(d) When it is deemed necessary to cut and destroy weeds or grosses on private property, in accordance with the
<br />provisions of this section, the owner shall be charged at the rate of one hundred dollars ($!00.00) per hour or portion thereof, or the
<br />actual cost of such work, whichever is the larger The minimum charge therefor shall be one hundred dollars ($100.00).
<br />1775.02 NUISANCE VEGETATION; GROWTHS OVER SIDEWALKS.
<br />(a) The following acts, things and conditions done or existing within this City are declared to constitute nuisances:
<br />(1) To cause or suffer debris, offal, filth, decaying vegetable or noisome substances to accumulate, collect or
<br />remain on any parcel of land.
<br />(2) To permit the growing or existence of Limbs of trees, branches, bushes, shrubs, briars, or vines so that the
<br />same or any part of them project over any sidewalk so as to interfere with or deprive pedestrians ofthe free
<br />and full use of such sidewalk.
<br />(b) If any of the nuisances defined in this section exist, said nuisance shall be abated and/or the owner, lessee or
<br />occupant of the premises shall be fined and/or imprisoned in accordance with Section 1701 99.
