maintained or suffered or permitted to be used or maintained as a dump. <br />1755.03 PERSONS PROHIBITED FROM DUMPS. <br />No persons, except those having material to dump or representatives of the City or authorized persons, shall be pemritted on <br />any dump. <br />CHAPTER 1787 <br />Storage and Use ofPCB and PCB Devices <br />1787.01 DEFINITIONS. <br />For the purpose of this chapter, the following words shall have the meanings ascribed to them respectively: <br />(a) "PCB" means any chemical substance that is limited to the biphenyl molecule that has been chlorinated to varying <br />degrees or any combination of substances, or mixture which contains chlorinated biphenyl molecules and which <br />contains SO ppm (parts per million) (on a dry weight basis) of PCBs. <br />(b) "PCB device" means any device which contains three pounds or mare of PCB, and includes capacitors and <br />transformers. <br />(c) "Person" means any natural or legally created artificial person including any individual, corporation, partnership or <br />association. <br />1787..02 USE OR STORAGE OF PCB AND/OR PC- DEVICES PROHIBITED. <br />After February I, 1982, no person shat) use or store any PCB or any PCB device within the City <br />1787.03 EXEMPTIONS. <br />(a) The provisions of this chapter shall not apply to the stomge or disposal of PCD or PCB devices in any hazardous <br />substance disposal site specifically approved 6y either the United States Environmental Protection Agency or the Ohio Environmental <br />Protection Agency and which comport to federal and State law <br />(b) A person may petition the Director of Public Safety or his designee for an exemption from the requirements ofthis <br />chapter and the Director or his designee may grant in writing an exemption, where not precluded by State or federal law, if he finds that <br />(1) Unreasonable risk of injury to health or environment would noC result; <br />(2) Good Faith efforts on the pan of the pe[itoner have been made [o comply bn[ strict compliance would <br />render undue hardship upon the petitioner or is not possible or practical; and <br />(3) The best interest of the City would be served by granting the exemption. <br />(c) The provisions ofthis chapter shall not apply to the use of waste samples of PBC, samples of other substances or <br />material containing PCB or PCB references samples for or in conducting analytical tests to determine the composition or characteristics <br />of the sample. <br />(d) The provisions of [his chapter shall not apply to the temporary stomge of PCB or PCB devices taken out ofservice in <br />compliance with this chapter, provided the temporary stomge does not exceed ten days from the date that the PCB or PCB device is taken <br />out of service. <br />1787.04 EXTENSION OF TIME FOR COMPLIANCE. <br />A person may petition the Duector of Public Safety or his designee for an extension of time for compliance with the provisions <br />ofthis chapter and the Director may grant a reasonable a#ension where not precluded by State or federal law if he finds that compliance <br />by the effrc[ive date ofthis chapter is no[ possible due to circumstances beyond the control and without fault on thepart of the petitioner <br />1787.98 ffiJUNCTIVE RELIEF. <br />(a) Violation of any provision of this chapter shall be deemed apublic nuisance. <br />(b) The Director of Law shall have the authority to commence any anion in a court of wmpe[ent jurisdiction to enjoin <br />the actions of any pemov who violates any provisions ofthis chapter <br />1787.99 PENALTY. <br />(a) Any person who violates any provision ofthis chapter shall be guilty of a misdemeanor ofthe firs[ degree. <br />(b) The use or stomge of PCB or individual PCB devices shall constiNte a separate offense for each location at which <br />such PCB or PCB device or devices are used or stored. <br />(c) Each dais violation shall constiNte a separate and distinct offense. <br />CHAPTER ]789 <br />Disposal of Sharp Waste <br />1789:01 SHARP WASTE DEFINED. <br />As used in this chapter, "sharp waste" means all used and unused hypodermic needles, and all other needles, syringes, razors <br />and broken glass that have come into contact, or are likely to have come inN contact, with infectious agents through, any means, <br />including, but not limited to, treatment or inoculation of human beings or animals and medioal or industrial research. <br />]789.02 DISPOSAL OF SHARP WASTE. <br />All sharp waste to be collected by the City Refuse Department shall be prepared for disposal in the following manner' <br />(a) It shall be rendered completely unusable for its original purpose. <br />(b) It shall be placed in a rigid, puncture-resistant container made of plastic, glass or metal. <br />(c) It shall be securely sealed with heary tape so as to ensure that the seal will not be broken when handled by Refuse <br />Department employees. <br />(d) All sharp waste sha0 be separated fora other waste and clearly marked "Sharp Waste." <br />1789.03 NONCOMPLIANCE; SPECIAL PICK-UP AND FEE. <br />If any person, firm, corporation, associaton, partnership or other entity fails to follow the procedures set forth in Section <br />L789.02 for the collection by City employees of sharp waste, the Director of Public Works shall arrange, at his discretion,. for a special <br />2$ <br />
