pick-up by City employees or a private company. The entire expense of such collection shall be determined by the Drector of Public
<br />Works and that amount, together with an administrative fee of one hundred dollars ($100.00), shall be charged and billed to such person,
<br />firm, corporation, association, partnership or other entity If such sum is not promptly paid, the Director of Law shall commence
<br />necessary legal action to collect the same. This charge shall be in addition to any fine or other penalty for violation ofthis chapter
<br />178999 PENALTY.
<br />(a) In addition to the charges provided in Section 1789.03, any person, fimt, corporatiory association, partnership or
<br />other enlity found to have violated any provision of this chapter shall be fined not less than two hundred fifty dollars ($250..00), nor more
<br />than one thousand dollars ($1,000), for each such offense. Any person found to have violated any provision ofthis chapter three times in
<br />any twelve~~month period may, in addition to a fine ar in lieu of a fine, be imprisoned for not more than six months.
<br />(b) In addifion to other penalties contained herein, the Director of Public Works may suspend refuse collection to any
<br />person, firm, corporation, association, partnership or other entity found to have violated any provision in this chapter three or more times.
<br />Such denial of refuse service may continue at the discretion of the Director of Public Works. During such suspension of service the
<br />violator shall be responsible to arrange for weekly refuse collection from a private hauler Failure to arrange for such weekly collection
<br />shall be a violation ofthis chapter and subject to the penalties contained in subsection (a) hereof.
<br />CHAPTER 1791
<br />Disposition of the Dead
<br />179].01 CERTIFICATE OR DEATH; RESPONSIBILITY OF UNDERTAKER.
<br />Every undertaker or other person having charge of the burial, cremation or deposit of a dead body in a tomb or vault, or the
<br />removal of a dead body, shall, within twenty-four hours after taking charge of such body, file with the Division of Puhlic Health a
<br />Certificate of Death, as required by law, completely filled out
<br />1791.02 BURIAL PERMITS; RESPONSIBILITY OF SEXTON.
<br />Upon tha Sling of such Certificate with the Division of Public Health, the official having charge of the enforcement ofthis
<br />Sanitary Code shall issue a Burial Permit which shall he presented to the sexton, superintendent or other person having charge of any
<br />cemetery, crematory or other place for the disposition of the dead. No sexton, superintendent or other person having charge of any
<br />cemetery, crematory or other place for the disposition of the dead shallbury, cremate or otherwise dispose of any such body unless he has
<br />received from the person presenting such body for burial, cremation or other disposal, a Burial Permit as provided by this chapter
<br />1791.03 UNEMBALMED BODIES.
<br />No undertaker or other person without a Permit from the official charged with the enforcement ofthis Sanitary Code, shall
<br />suffer or permit any unembalmed body to remain unburied or uneremated, unless such body is in a public morgue, for more than forty-
<br />eight hours.
<br />1791.04 BURIAL WITHDDTA PEHMIT.
<br />No undertaker or other person shall suffer or permit any body to be buried, cremated or deposited in a tomb or vault other than
<br />a cemetery, burying ground or crematory duly registered according to law, without a permit from [he official charged with the
<br />enforcement of this Sanitary Code. (Ord. 2276. Passed 10-13-24.)
<br />1791.05 REPORTING UNBURIED BODIES.
<br />Any person having knowledge of any unburied body, the existence of which has not been reported to the Division of Public
<br />Health, shall report the existence ofsuch unburied body to such Division.
<br />1791.06 EXPOSURE OF DEAD BODY.
<br />No person or persons shall retain, expose or allow to be retained or exposed the dead hody of any human being so as to
<br />endanger or imperil the life or health of any person.
<br />CHAPTER 1793
<br />Tattooing
<br />1793.01 DEFINITIONS.
<br />As used in this chapter:
<br />(a) "Health Commissioner" shall mean the administrative official charged with the duty of creating policy, and
<br />administering the regulations and Laws which promote the health and sanitation of [he citizens of the City of
<br />Lakewood.
<br />(b) "Health Officer" shall meana duly authorized employee ofthe Division of Health for the CiTy ofLakewood.
<br />(c) "Certificate of inspecfion" shalt mean written approval from the health officer or his authorized representative that
<br />said tattooing establishment has been inspected and meets all ofthe terms ofthis chapter
<br />(d) "Operator" shall mean any individual, firm, company, corporation or association that owns or operates an
<br />establishment where tattooing is performed and any individual who performs or practices the art of tattooing on the
<br />person of another.
<br />(e) "Tattoo', "tattooed" or "tattooing" refer to any method of placing designs, letters, scrolls, figures, symbols or any
<br />other marks upon or under the skin with ink or any other substance resulting in the coloration of the skin by the aid
<br />of needles or any other instruments designed to touch or puncture the skin.
<br />(f) "Tattoo establishment" means the location wherein tattooing is performed.
<br />1793.02 LICENSE REQUIREMENT.
<br />(a) It shall be unlawful for any person to engage in the business of operating a tattoo establishment without first
<br />obtaining a license to engage in such business in accordance with the provisions hereof
<br />(b) An application for a license shall be accompanied by a fee in the amount of two hundred dollars ($200.00} Any
<br />change of ownership shall require a new application and license, with payment of fees therefor
<br />(c) The license fee for engaging in the business of operating a tattoo establishment within the Health District shall be two
<br />hundred dollars ($200.00) per year Said license shall expire on December 31st of each calendar year, and the fee for licensing shall not
<br />be prorated.
