Health Commissioner, indicating the establishment has been inspected and is in compliance with the provisions ofthis chapter <br />(b) The Health Commissioner shall conduct annual and other periodic inspections, as maybe necessary, of any tattooing <br />establishment For the purpose ofdetermining whether or not said establishment and the persons performing the art ofta[tooing Herein are <br />in compliance with all applicable health provisions contained within this regulation and other pertinent regulations ofthe Health District. <br />It shalt be unlawful for any person or operator of a tattooing establishment to willfiilly prevent or restrain the Health Commissioner, or <br />his. designee, from entering any licensed establishment where tattooing is being performed for [he purpose of inspecting said premises, <br />after proper identification is presented to the operator <br />(c) The Certificate of Inspection shall be posted within [he tattoo establishment to serve as public notice that said <br />establishment hes been inspected and is in compliauce with the provisions ofthis chapter <br />1793.07 TATTOOING DISEASED, INTOXICATED OR DRUGGED PERSONS; <br />MINORS. <br />(a) It shalt 6e uNawtul [o tattoo any person who is known to have, or who shows signs of having any communicable <br />disease or any disease ofthe skin, including rashes, pimples, boils, infections or any manifestation or evidence of unhealthy conditions. <br />(b) It shall be unlawful to tattoo any individual under the influence of alcohol and/or any narcotic drug or drug of abuse. <br />(c) It shalt 6e unlawful for any tattoo operator to be under the influence of alcohol and/or narcotic drug or drug of abuse <br />when tattooing. <br />(d) It shall be uvlawflrl to tattoo any Individual who is uuder twenty-ono (21) years of age, regardless of whether the <br />operator knows this person to be Less than twenty-one (21) years of age, or the operator is reckless in that regards <br />(e) Whoever violates this section is guilTy of a misdemeanor of the first degree. This section shall 6e enforced by the <br />Director oFPublic Safety or designee, the Division of Police, or auy public health official. <br />1793.99 PENALTY. <br />(a) The Division ofHealth may suspend or revoke a tattoo establishment license for violation ofthis regulation. <br />(b) The provisions ofthis chapter shall apply to all tattoo establishments and/or tattoo operators which are curcemty in <br />existence, or which may come into existence after the effective date ofthis chapter. The provisions ofthis chapter shall not apply to a <br />physician licensed to pmetice medicine in the State of Ohio who is tattooing for a medical purpose. <br />(c) In the even[ of conflict between any provisions ofthis chapter or the Ohio Revised Code, including any rules and <br />regulations adopted pursuant to this chapter or the Ohio Revised Code, and any provisions of City ordinances, including any rules and <br />regulations adopted pursuant to such ordinances, that provision or ordinance which establishes the higher standazd for the promotion or <br />protection ofthe health or safety ofthe people shall govern. <br />(d) Whoever violates this regulation shall be subject to the penalties of Ohio Revised Code 3709 99 or Ohio Revised <br />Code 3707.02, unless otherwise specified in this chapter <br />Shall be and is hereby amended to read as follows <br />31 <br />
