CRAFTER 1701 <br />Administration and Enforcement <br />1701.01 SANITARY CODE IDENTIFIED. <br />Sections 1701.01 [0 1793.99 of these Codified Ordinances shall be known as the Sanitary Code of the City and may be <br />separately printed and distributed. <br />1701.02 ENFORCEMENT. <br />The Mayor or Director of Public Safey, and any officer or employee designated for that purpose by the Mayor or Director of <br />Public Safety are hereby charged with the enforcement of this Sanitary Code. <br />1701.03 NOTICE REQUIl2EMENTS. <br />A notice served on the owner or agent of any property, or left at the residence of any owner or agent, or if, after due search, <br />neither can be found, or both reside out of the City, posted on the front door, wall or Fence of such property, and an advertisement <br />inserted for one week in a newspaper of general cirwlation in the City, shall be considered sufficient and ample service. The cost of such <br />advertisement shall be assessed and collected the same as any other tax in favor of the City or may be added to the cost or damages of <br />suit when such suit is brought. <br />1701..05 POWERS OF HEALTH OFFICERS.(REPEALED) <br />1701.055 SPECIAL POLICE OFFICERS. <br />(a) The Mayor or Director o£Public Safety is hereby authorized to commission the the Animal Control Officers or other <br />employees as special police officers charged with the enforcement of any valid ordinance within the Citiy of Lakewood as assigned... <br />(b) The following rules shall apply to such special police officers and their commissioning' <br />(1) The special police officers shall receive no additional compensa5on for their duties as such. <br />(2) The special police offieere shall not be on the classified list of the Police Division or eligible for <br />participation in the Police Pension PLnd. <br />(3) The special police officers shall have the powers to issue misdemeanor citations and/or complaints and <br />order the abatement of nuisances in the exercise and performance of their duties as set forth in this Sanitary Code, the General <br />Offenses Code and other similar ordinances, statutes, rules or regulations relating or applicable to streets, sidewalks, tree lawns <br />or other property belonging to the City and/or relating to the health of the City, and in such other specific cases as the Mayor <br />may from time to time direct. The Animal Warden shall enforoe all ofthe ordinances of the City relative to animals, <br />1701.06 SEPARABILITY. <br />Each section and each part of each section of this Sanitary Code is hereby declared to be an independent section or part of <br />section, and the holding of any section or part of section to be invalid or ineffective, or the holding of the application of any Becton or <br />part of any section to any person or circumstance to be invalid or ineffective, shall not affect any other section or part of section, or the <br />application of any section or part of section to any other person or circumstance. <br />1701.07 COMPLWNCE REQUIRED. <br />It shall be unlawful for any person, firm or corporation to do any act or thing prohibited by any of the provisions of this <br />Sanitary Code, or to omit to do any actor Thing required of any such person, firm ar corporation by any of the provisions of this Sanitary <br />Code. <br />1701.99 PENALTY. <br />Whoever violates any of the provisions of this Sanitary Code for which no penalty is otherwise provided shall be fined not less <br />than twenty- five dollars ($25.00) nor more than five hundred dollars ($500.00) or imprisoned for not more than sixty days, or both, and <br />shall stand committed until such fine be paid or sentence served, or until otherwise discharged by due process of law Each day's <br />violation shall constitptea separate offense. ' <br />CHAPTER 1703 <br />DeBvitions <br />1703.0] MEANING OF WORDS AND PHRASES. <br />For the purpose of this code certain words and phrases are defined as fotlows~ <br />1703.02 COMMUNICABLE DISEASE. <br />"Communicable disease" means a disease which can be communicated or transmitted by one person or animal to another by <br />any means whatsoever <br />1703.03 COURT. <br />"Court" means an open space bounded on one or more sides by the wads of a building, the bottom of which open space is <br />either above or below the ground level of the lot on which such building is located, and which is clear, open and unobstructed from the <br />bottom thereof to the sky <br />1703.04 DRUG. <br />"Drug" means and includes all medicines and preparations recognized in the United States Pharmacopoeia, or in the National <br />Povpulary or its appendix, or in other recognized standard works for ivtemal or ex[emat use, and any substance or mixture of substances <br />whatsoever manufacNred, sold or given away for use in the treatment of any disease of either man or animal. <br />1703.05 DWELLING. <br />"DweOing" means any building or any part thereof which is wholly or partly used or intended to be used for livivg or sleepivg <br />by human occupants <br />1703.06 DWELLING HOUSE. <br />"Dwelling house" means any building or portion of any building used as a place of human habitafion other than a tenement <br />house and rooming house. <br />1703.07 DWELLING UNIT. <br />32 <br />
