(b) Ifthe water supply, water closets and privies are used on common. <br />1703.23 YARD.. <br />"Yard" means an open, unoccupied space, other Ihan a court, and unobstructed from the ground level to the sky <br />1703.24 SHALL. <br />"Shall" is always mandatory and not directory <br />1703.25 ADEQUATE, PROPER, SUFFICIENT AND SUITA-LE. <br />"Adequate", "proper", "sufficient" and "suitable" mean adequate, proper, sufficient and suitable in the judgment of the official <br />charged with the enforcement of Phis Sanitary Code. <br />1703.2fi OFFICIAL CHARGED WITH THE ENFORCEMENT OF THIS SANITARY CODE. <br />"Official charged with the enforcement of this Sanitary Code" means the Mayor and any other officer or employee designated <br />for that propose by the Mayor <br />CHAPTER 1711 <br />Shops and Places afAssembly <br />]711.0] 6HOPS; CLEANLINESS AND REPAIR. <br />Every workshop and all parts thereof and places appurtenant thereto shall be maintained in good repair and shall be kept <br />thoroughly clean and free from any accumulation of filth, garbage, rubbish or other waste, <br />1711.02 SHOPS; WASTE RECEPTACLES. <br />Receptacles sufficient to contain all of the garbage, rubbish and other waste produced in or on the premises of any workshop <br />shall be provided as required by ordinance. All garbage, mbbish and other waste shall be disposed of as required by ordinance. <br />1711.03 PLACES OF ASSEM-LY; CLEANLINESS AND REPAIR <br />Every place of assembly and aU parts thereof and places appurtenant thereto shall be maintained in good repair, and shall be <br />kept thoroughly clean and free from any accumulation offilth, garbage, rubbish and other waste. <br />CHAPTER 1721 <br />Public Swimming Pools <br />1721.01 DEFINITIONS. <br />"Building Commissioner" means the Buildiog Commissioner of the City of Lakewood or his/her authorized representative, for <br />purposes of this Chapter <br />1721.02 CONSTRUCTION PERMIT FOR PUBLIC POOLS. <br />Before work is commenced on the construction of a public swimming pool or public wading pool or on any alteration, <br />addition, remodeling or other improvement thereto, an application for a pemtit to construct and the plans and specifications and pertinent <br />explanatory data hereinafter regnired shall be submitted to the Ohio Department of FIealth, and the Building Commissioner for approval. <br />No part of the work shall be commenced until the Ohio Department of Health and the -uilding Commissioner have evidenced their <br />approval by the suitable endorsement upon such plans and specifications, and have granted a permit thereof <br />1721.03 CONSTRUCTION PERMIT FEE. <br />The fee for the permit to construct a public swimming pool shall be the same as that prescribed fora "Structure" within the <br />Division of Building's Permit Fee Schedule. Such fee is in addition to permit fees applicable to other structures which maybe incidental <br />to the pool, or plumbing, sewering or wiring connections therewith. <br />1721.04 COMPLIANCE WITH REQUH2EMENTS OF STATE DEPARTMENT OF HEALTR. <br />In the constrmction, operation and maintenance of any swimming pool, laws of the State of Ohio and the rules, regulations and <br />requirements ofthe State Department of Health shall be observed, In the event of any conflict between the provisions of this chapter and <br />any provision of State law or requirement, role or regulation of the Ohio Departnent of Public Health, the provision imposing the higher <br />standard or the more shingent requirement shall be controlling. <br />1721.05 LIGHT ARRANGEMENT. <br />Lights used to illuminate any pool shall be so arranged and shaded as to reflect light away from adjoining premises and public <br />streets. Such lights shall be tamed off at 10'.00 p.m. and shall remain off until 8x.30 a.m. <br />1721.06 DESIGN AND CONSTRUCTION REQUllIEMENTS. <br />The Building Commissioner shall not issue a permit to construct or approve the construction of any public swimming pool or <br />any alteration, addition, remodeling or other improvement thereto unless all state requirements are met. In addition, all indoor public <br />pools which are to be used when the outside temperature is below sixty degrees Fahrenheit shall be provided with facilities for uniform <br />and adequate heating offhe pool room, dressing rooms and water in the pool. <br />1721.07 ENFORCEMENT. <br />No persoq firm or corporation owning or having the possession, charge or management of any public swimming pool, public <br />wading pool, or other artificial body of water shall permit the same to be constructed, used or maintained unless all the provisions ofthis <br />chapter and all other laws and ordinances relative to any public swimming pools, public wading pools, or other artificial bodies of water <br />are complied with. <br />CHAPTER 1722 <br />Family Swimming Pools <br />1722.01 LOCATION OF FAMILY POOLS. <br />(a) In addition to requirements contained in Section 1123 10(c) and 1121.10 (c) of the Lakewood Zoning Code, no <br />family swimming pool or family wading pool shall be placed or located in any front yard or side yazd as prescribed by the Lakewood <br />Zoning Code applicable to [helot or parcel upon which such pool is situated. <br />(b) Unless otherwise spedflcally provided the standards and regulations of this chapter shall not be applicable to family <br />34 <br />
