is prepared, manufactured or cooked for sale or kept for sale or sold, shall be deemed to be shops regardless of the number of persons <br />employed or engaged [herein. <br />1703.34 STABLE. <br />"Stable" means any building used for the feeding or sheltering of animals or fowl. <br />1703.35 SUPPLIED. <br />"Supplied" means paid far, furnished or provided by or under the control of the owner or operator <br />1703.36 TENEMENT HOUSE. <br />"Tenement house" means any house or building or portion [hereof which is occupied in whole or in part as the home or <br />residence ofthree or more families living independently of each other and doing their cooking upon the premises, and includes apartment <br />houses, flat houses, flats and other houses so occupied. Dwelling houses occupied as the home or residence of less than three families <br />shall be deemed to be tenement houses under either of the following conditions' <br />(a) Ifbuilt m convected rows or terraces. <br />(b) If the water supply, water closets and privies are used on common <br />1703.37 YARD. <br />"Yard" means an open, unoccupied space, other than a court, and unobstructed from the ground level to the sky <br />1703.38 SHALL. <br />"Shall" is always mandatory and vot directory <br />1703.39 ADEQUATE, PROPER, SOFFICIENT AND SUITABLE. <br />"Adequate", "proper", "sufficienP' and "suitable" mean adequate, proper, sufficient and suitable in thejudgment of the official <br />charged with the enforcement ofthis Sanitary Code. <br />1703.40 OFFICIAL CHARGED WITH THE ENFORCEMENT OF THIS <br />SANITARY CODE. <br />"Official charged with the enforcement ofthis Sanitary Code" means the Mayor and any other officer or employee of the <br />Division of Public Health designated for that purpose by the Mayor <br />CHAPTER 1711 <br />Shops and Places of Assembly <br />]711.01 SHOPS; CLEANLLNESS AND REPAIR. <br />Every workshop and all parts thereof and places appurtenant thereto shall be maintained in good repair and shall be kept <br />thoroughly cleamand free from any accumulation of filth, garbage, rubbish or other waste. <br />1711.02 SHOPS; WASTE RECEPTACLES. <br />Receptacles sufficient to contain all of the garbage, rubbish and other waste produced in or on the premises of any workshop <br />shall be provided as required by ordinance. All garbage, rubbish and other waste shalt be disposed of as required by ordinance. <br />1711..03 PLACES OF ASSEMBLY; CLEANLINESS AND REPAIR. <br />Every place of assembly and alt parts Orereof and places appurtenant thereto shall 6e maintained in good repaiq and shall be <br />kept thoroughly clean and free from any accumulation of filth, garbage, rubbish and other waste. <br />CHAPTER 1721 <br />Pu61ic Swimming Pools <br />1721.01 DEFINITIONS. <br />The following definitions,.terms, phrases, words and their derivations shall apply to this chapter <br />(a) "Health Commissionef' means the Health Commissioner of the City of Lakewood, or his/her authorized <br />representative. <br />(b) "Building Commissionet' means the Building Commissioner of the City of Lakewood or his/her authorized <br />representative. <br />1721.02 CONSTRUCTION PERMIT FOR PUBLIC POOLS. <br />Before work is commenced on the construction of a public swimming pool or public wading pool or on any alteration, <br />addition, remodeling or other improvement thereto, an application foi a permit to construct and the plans and speoifications and pertinent <br />explanatory data hereinafter required shall 6e submitted to the Ohio Department of Health, and the Building Commissioner for approval. <br />No part of the work shall be commenced until the Ohio Department oFHeatth, the Health Commissioner and the Building Commissioner <br />have evidenced their approval by the suitable endorsement upon such plans and specifications, and have granted a pennii thereof <br />1721.03 CONSTRUCTION PERMIT FEE. <br />(a) Pemiits. The fee for the permit to construct a public swimming pool shall 6e the same as that prescribed for a <br />"Shucture" within the Division of Building's Permit Fee Schedule. Such fee is in addition to permit fees applicable to other structures <br />which maybe incidental to the pool, or plumbing, sewering or wiring connections therewith. <br />1721.04 COMPLIANCE WITH REQUIREMENTS OF STATE DEPARTMENT <br />OF HEALTH. <br />In the construction, operation and maintenance of any swimming pool, laws ofthe Stale of Ohio and the rules, regulations and <br />requirements of the State Departrnent of Health shall be observed, In the event of any conflict between the provisions ofthis chapter and <br />any provision of State law or requiremen; mle or regulation of the Ohio Department of Public Health, the provision imposing the higher <br />standard or the more shingent requirement shall be controlling. <br />1721.05 LIGHT ARRANGEMENT. <br />Lights used to illuminate any pool shall be so arranged and shaded as to reflect light away from adjoining premises and public <br />
